Municipal property that is misappropriating, irregularities in contracts and construction permits are some of the irregularities the National Auditor's Office for the Mitrovica Community has listed in the 2019 financial mirrors report.
Some of the ERK's findings that have been recorded in the audience's report on the Mitrovica municipality, which is led by Agim Bahtiri of the Vetevendosje Movement, may also be subject to treatment for investigators, reports news.
Under the Law, real estate of the municipality can be provided in exploitation for all persons at a certain time. Under the terms of the contracts, the payment of the obligation must be made by the 10th of each month.
The contract stipulates that the Municipal Parliament every 2 years should reevaluate the economic situation of households, with the aim of continuing/repressing the contract's validity. After completing the set deadline in the contract for providing real estate exploitation to the municipality, the property is returned to the municipality.
From testing public property users' lists (the renting establishments, assigning residences to families of martyrs, social cases and quadro) out of 80, the audience has found that of the 14 rented establishments, in 6 of them came in from rent, while in 8 other cases municipalities do not bill and do not register in.
Also, according to Auditor, users in two cases operated without contracts as a result of the unilateral split of the contract from the municipality in the absence of rent payments.
“In residential complexes leased to martyrs' families and social cases (36 families) as well as to the 2003 family funding), user situations and contracts have not been verified since 2011, 2018 for the Framework Fund, respectively. The municipality doesn't register and it doesn't bill the tenants because they've expired the contracts. However, property is still exploited without a formal or renewed contract decision; and in the 17 residences given in Stan Targ in 2018, users had paid the rent only for the first few months, while for the rest they had not paid, thus amassing debts of 5,186 euros”, the report said.
According to the ZKA, continuing such practices could trigger other debtors to avoid renting and not obtaining leases from property use, the municipality causes budgetary losses worth 18,289 euros a year and increases the risk of failing projects planned by personal resources, or even new projects in behalf of citizens.
Disregard in issuing construction permits
According to Law No. 04/L -110 for construction, Article 4 specifying that issuing construction permits and determining its requirements will be applied to the following principles: point 1.1. Health and security protection, as well as Article 21 procedure for issuing construction permit point 2. If the competent body estimates that construction documentation is not prepared in accordance with the construction conditions and provisions of this law, it will not issue construction permits.
From testing eight samples for issuing construction permits, the audience has found that in one case the construction permit decision had been issued eight months before the South Mitrovica Commission's Directorate for Defence and Rescue was approved.
ZKA says that in four other cases the decision on construction permits to the fire protection section and noise protection was issued on two of them without the signing of a document checkout, and in two other cases the list in question was signed 1 26 days respectively after the construction permit was issued.

Signing contracts beyond anticipated budget value
According to the LPP, if the contracting authority is a budgetary organisation and relevant procurement will cause the establishment of financial obligations, which will be met by budgetary divisions expected to take place in the coming fiscal years. The ZKF will ensure that the attached provisions of the Law on Business Divisions provide reasonable grounds to expect that in the coming fiscal years sufficient funds will be provided to meet such obligations. In this regard, the audience has found that co-finances with the Ministry of Environment and Spatial Planning for the “Rule of the Sitnica-Mitrovica River bed” ) the projected and budgeted value for three years was 3,10,000 euros, while the contract was signed at 6,045,726 euros with a margin of 2,945,726 euros, the highest planned value.
Project “Rule of the Iber-Mitrovica Riverbed”- the projected and budgeted value for three years was 950,000 euros, while the contract was signed at 1,777,427 euros, or 827,427 euros higher than the anticipated value.

During physical examinations on the Auditor field, the following identified shortcomings have been noted:

A violation of procurement procedures
For two16 high-value projects, contracts linked between municipality and economic operators, the ZKA says they were signed by the chief of the procurement office, but were not signed by the mayor of the municipality, ignoring specific LPP requirements, Article 26, respectively, that high-value contracts, besides procurement manager, should be signed by the chief Administrator Officer, the mayor of the Commission, respectively.
“The signatures set by this article confirm and accept the rights and obligations defined in the contract, otherwise the contracts are unmet. After the remarks on our part the contracts were signed on the part of Chairman”, the ZKA says.
Also, according to Z. KA, the municipality had developed out of procurement plan tender procedures for the “Building the monument of the market massacre”, not announcing, AQP as required with the LPP's 9.6 article for procedures that are not included in the annual procurement plan.
Meanwhile, with the date 04.02.2019 municipalities had signed contracts worth 2,468,275 euros for the “construction, construction and repair of roads and sidewalks in co-finance with citizens“. In the ZKA report, it is said that the contract in question was not presented in the annual report of public contracts, as requested with Article 87 of the LPP, that any contract signed be introduced in the annual contract report identifying with reasonable details all the supplies, services and jobs that the contractor authority has conducted over the year.
