The accused Peci was initially sentenced to 4 months in prison, but with the consent of the same, the prison sentence was replaced by fines in the amount of 2,500 euros, reports “Justice Vow”.
Under the trial declared on May 12th 2020, provided by “Justice Vow”, it turns out this court had approved the plea agreement linked between the Special Prosecutor of the Republic of Kosovo (PSRK) and the accused Peci.
In the conviction pronounced, under this indictment, the time the accused spent in custody will also be counted from March 26th to April 29th, so that each day will be estimated at 20 euros.
The Foundation's decision says that the remainder of the sentence -- in the amount of 1,840 euros -- will be executed after the integrity of this act.
Similarly, the court has approved the defence requirement that the remaining portion of the fined sentences be paid in monthly installments, due to the accused Peci's poor economic situation.
Under this decision, if the accused does not pay the fine sentence, he will be reduced to prison sentences, accounting for a 20-euro prison day of fine.
Also, the accused Peci is obliged to pay the 50-euro sum in account of the judiciary and 50 euros on behalf of the fund for compensation of crime victims.
The injured, Republic of Kosovo President Hashim Thaci, for realising the property legal requirement has been directed in civil conflicts.
The decision reportedly said that on April 24, 2020, prosecutor Habibe Salihi had filed a plea agreement with the prosecution, indictees Peci and his defender, lawyer Xhafer Maliqi, in court.
Under this agreement, the first-instance court was recommended that a prison sentence of four to five months be pronounced against accused Peci be pronounced on the accused.
Later, the court, acting in accordance with this criminal case on May 12, 2020, held the session for reviewing this agreement proposed by the parties concerning indictees Peci.
This agreement was also approved by the Constitutional Court in Pristina with the argument that it contains all conditions defined with provisions of Article 233 par.3, 4 and 5 of the KPRK.
Also, the court had estimated that the plea agreement was in accordance with Article 233 par.1 under the par.1.1 of the KPPRK and Article 233 par.7 under the KPPRK's par.2, and that the proposed sentence was within legal frameworks.
The Special Prosecutor of the Republic of Kosovo (PSRK), on April 17, 2020, has filed an indictment against Mejim Peci because of the new Criminal Code of the Republic of Kosovo “Kanosja”, from Article 181 par.3 concerning par.1.1.
According to the indictment filed by the PSRK, Mejim Peci is charged with being on March 26, 2020, via the social network “Facebook”, seriously affected, President of the Republic of Kosovo Mr. Hashim Thaci, in regard to his work as an official person, would have done him some harm in order to intimidate or cause anxiety.
The PSRK claims accused Metom Peci, in the profile of the person who had already opened it, has posted the threatening message with content as follows: “Today, stretched from the ceiling that the Assembly is talking about partitioning Kosovo by Hashim Broya, let Hashim Broya know whether he is still alive, the northern part. We don't allow partition or Hashim Broya, know that sleep sleep séta left with ba”, accompanying these words with two photos of two long arms, with cerces on the injured one has caused fear and anxiety that any harm will be caused to him or his family by defendant Metom Peci.
