Prizren municipality failed to manipulate a tender worth over 50,000 euros

The winners of the tender “Development and Institution maintenance for the city of Prizren” were declared contrary to the demands the municipality wrote on the tender file and the contract announcement.

If a racing company for this tender were not to complain in the Procuring Organisation, the municipality would sign the contract with companies that failed to meet the legal requirements, writes news.

Initially in March of this year, the municipality made contract announcements for the tender “buildup and maintenance of the town of Prizren”, where the projected value of the contract was 80 thousand euros.

The municipality accepted three offers.

The winners announced the Economic Operator Group's bid: OFFICE 1 KOSOVA” S.P.K.; “IDEA Plus Communications”, worth a total offer of 53.707,00 euros, after being assessed as an offer that had filled all the ranks according to the tender file and contract announcement.

Company “Sfinga”Sh.k.k, had a price of 59,999,95 euros. Her offer was deemed responsible but disqualified because it was priced more than winning.

The third bid was N Company. S. “Spink Agency”, worth 63.580,00 euros. This company was declared irresponsible on several points.

The Community Admits It Was a Sin

Counter-admitting announcement of the contract came in second cheaper company “Sfinga”, claiming that the contract-designed company has failed to meet a set of criteria which the municipality had placed in the tender file. After this company's complaint to the Accounting Authority, the municipality has suspended the tender procedure and reviewed the complaint with claims. The review expert, dated June 5th, has submitted the expertise report and found that there have been violations and recommended that the tender be returned to re-evaluation.

Random, the contracting authorities do not accept the investigative expert's decision when against them, and await the panel's decision, but Prizren's municipality has accepted O expert's opinion. The EPS, thus considering that it committed violations of the law when it declared the winner.

It is noteworthy that the expert has found violations in nearly all claims put forward in the municipality by the complaining company, but that the municipality had not taken it to base, while with the expert's opinion it was hired.

The municipality violated the criteria it set itself
