The specialised prosecutor days ago proposed charges against the country's president, Hashim Thaci, and PDK chairman Kadri Veseli. Awareers of the circumstances of justice and politics think differently about Thaci's eventual resignation from the president's position.
Betim Musliu from the Kosovo Institute for Justice, says that despite the country's Constitution not imposing on such an act, it would be inappropriate for the country to be led by an institutional leader, for whom the war crimes charges weigh down.
“think that the resignation of President Thaci is inevitable given the integrity of institutions and the Republic of Kosovo itself, which would be damaged if President Thaci on a still unconfirmed charge stood in the position of Kosovo president. Simply bringing the president now should be dignified in order to resign to preserve the dignity of the presidential institution, and also Kosovo's image in the international factor. It would be inappropriate for a state like Kosovo to be led by an institutional leader, who has an act yet alleged unconfirmed. But over it are charges of war crimes”, he says.
But, contrary to this, political analyst Ramush Tahiri, who for Kosovo Preress said his resignation from the president's position should come after the indictment is confirmed by Kosovo's Specialised Chambers, headquartered in The Hague.
“Hashim Thaci at the moment you filed the indictment now is the indictment proposal, which the judge accepts, must resign. Some say it's official, I say it's legal. In the Kosovo Constitution, in the competencies of the prime minister and president it is said that if an indictment was filed by The Hague International Court and the court of this rank, the person holding the post must resign, free the post so that it can be faced as a private person there. I think and believe that Hashim Thaci will thus behave”, he says.
In spite of that, the state's first one, Hashim Thaci is not obliged to resign to the legal and constitutional basis.
From the IKD, Betim Musliu says there is no competence in the Constitutions that forces Thaci to resign.
“We assess that no competence exists in the Kosovo Constitution that forces Kosovo's president in this period to resign”, he says.
The two KLA leaders -- the president, Hashim Thaci and PDK chairman Kadri Wessel -- were made public Wednesday, the indictment proposal for war crimes by the Specialised Prosecutor's Office.
