During the trial management, prosecutor Ilaz Beqiri had withdrawn from prosecution for the 1 point of the indictment “preventing the official person from performing official task”, while in the final address, he had demanded that Ismaili be charged with points 2 of the indictment “the use of the weapon or dangerous tool” be found guilty and condemned by law.

He had stated in the final address that, from evidence administered in the judicial examination, Ismaili had confirmed that in the case of control by the Kosovo Police, in the lobby of the Republic of Kosovo's Parliament, in his shoes were found and seized two gas canisters, which according to the prosecutor, he had kept without authorization and in order to put them into the session, to be used by him or his colleagues.

This actual situation, according to the prosecutor, was also confirmed by the confirmation of the seizure, but you said Ishmael, with the aim of avoiding criminal responsibility, had refused to sign that claim.

Unlike prosecutor Beqiri, defender of the accused Ismaili, lawyer Betim Shala had demanded that Ismaili be acquitted of the prosecution.

In his final address, he had stated that the prosecution, to testify to the commission of the criminal act, had presented only a confirmation of the temporary takeover of the items, which, according to him, the prosecution had not demanded that this temporary measure be converted permanently and the weapons seized.

Otherwise, according to the indictment of January 5, 2015, he allegedly on November 30th 2015 in the lobby of the Republic of Kosovo's Parliament, during a police raid, two tear gas canisters had been found and seized by the defendant, who had hidden them in his shoes in order to put them into the plenary hall of Kosovo's Parliament.

While for the milestone of 2 of the indictment, which the prosecutor has withdrawn from prosecution, he was suspected that on November 17th 2015, at the exit of the Kosovo Parliament, he had prevented Kosovo Police members Isuf Xhemajlin, Mehdi Kozhani, Rifat Gashi, Ali Berisha and Faik Krasniqi from carrying out official duties.

According to this indictment, the moment police had attempted to stop him and accompany his other Vetvendosje MP, Albin Kurti, accused Ismaili, approaches other MPs in the middle and unable to accompany him to the police.

Already Ishmael is only charged with the use of tear gas.
