Bajrami says it is illegal to publish unconfirmed indictment against Thaci and Wessel

Jurydical Faculty Professor Arsim Bajrami has said the Specialised Prosecutor's Office has taken an illegal and unacceptable move with the unconfirmed publication or indictment against the political leaders of KLA11). The prosecutor made it known that the publication of the indictment was done because there was sufficient evidence that [the] president of the [...]
The prosecutor made it known that the publication of the indictment has been made since there was sufficient evidence that Ksoova President Hashim Thaci and Ksoova's head PDK, Kadri Wessel, have tried to sabotage the work of the Special Court. But Bajrami says the move has been unfair.
Unacceptable and illegal act by the Specialised Prosecutor's Office to publish the announcement of an unconfirmed indictment against the political leaders of the Kosovo Liberation Army. Uh, Bajrami said.
“amandation 24 of the Constitution, in paragraph 2, imposes the Specialised Chambers and Prosecutor Specialised Office to ensure the fundamental rights contained in Chapter II of the Constitution, including guaranteeing the right to presumption of innocence until it proves otherwise in accordance with the law.”, he added.
In the concrete case, the Specialised Prosecutor's Office has not only violated this constitutional right, but also violated the rules of procedure adopted by this institution, with the fact that the announcement of the existence of an indictment, to date, has not been confirmed by the Special Chamber, in the period of six months since its surrender. )
Bajrami says that disciplinary procedure could be initiated against the prosecutor in question.
In the rules of procedure, it is quite clear that an unconfirmed indictment cannot be made public, and furthermore, the announcement of the publication for its existence is a valid basis for this prosecutor to initiate disciplinary procedure for flagrant violation of the Ethic Code, an act adopted by these judicial institutions as well. He adds.
Bajrami says the KLA war has been fair and that its glory can never be denigrated.
“Such a communiqué of the Specialised Prosecutor's Office is political and unprecedented, and as such, must be denounced and rejected by political and judicial means, and called for account for the irreparable consequences that are causing Kosovo, on the international level.”, he says.
The reconciliation of Specialised Chambers can only be repaired when they reject an accusation such as the latter, politically motivated, selectively and because of the essential violation of the procedure rules on the part of the specialised Prosecutor's Office. No, Barjam ends.
