Thaci adviser Kurti: At Venice Commission, unfortunately they'll laugh at your amateurism

Thaci's adviser, Adil Behramaj, has reminded Kurt of the time when his party had ignored the Venice Commission's opinion of the Law of Religious Freedoms. Behramaj has said it was Kurti's party that had blocked Kosovo's Parliament for years and implemented that opinion in Kosovo legislation.

Since Kurt is so obsessed with the Venice Commission, Behramaj has said it is good for his team to print the Venice Commission's opinions on the mandate and immunity of MPs, the state of emergency and respect of human rights. Similarly, he has said let the opinion prepared for the importance of preserving parliament's role at the time of the COVID-19 pandemic by the Council of Europe, whose body is also the Venice Commission.

“Kurti and his party lack expertise and experience on many issues, including legal and constitutional issues. Education of the new prime ministerial issue on the Venice Commission is a mockery of the state of Kosovo. Venice Commission members will laugh at the amateurism of Kosovo Prime Minister, who has no knowledge of the procedures of an organisation where Kosovo had become a member in 2014, when Prime Minister Hashim Thaci was.

At the same time when the Constitutional Court is dealing with the specific question posed by Kurt's own party, they think they can get a second opinion. This is entirely against the Venice Commission's procedures to address an issue, which is already being considered by the Constitutional Court. The issue has yet to be answered and nobody is above constitutional courts of states. So even the Venice Commission, because his thoughts are not binding!

The Venice Commission's main task is to offer the states judicial advice in the form of “judicial inputs” for bills or legislation already in force, which has been submitted to it for review.

The Venice Commission may be asked by the Constitutional Court for assistance in a thought-tank of Amicus Curiae. At the request of a Constitutional Court or the European Court of Human Rights, the commission can provide opinions of Amicus Curiae, not on the constitutionality of the act in question, but on comparable constitutional and international issues!
