“The constitution makes final decision before May 28,”

The Constitutional Court could make the final decision before May 28th, a deadline for the provisional measure that has been imposed yesterday for President Hashim Thaci's decree to Prime Minister Avdullah Hoti for prime minister.
Analyst from Democracy Plus Albert Krasniqi believes the final decision will be ahead of the deadline when it is set as a temporary measure.
While Krasniqi as the connoisseur of the constitutional issue says that the provisional measure deadline by May 28th should not be taken as a deadline, because it is an optimum and orientation deadline within which the Court can come up with a decision.
“Afat until May 28th, which has been appointed by the Court to keep this temporary suspension measure, does not mean that it is the deadline when the Court can come up with the final decision. Since we may easily have a decision before that date, we may also have a decision after that date. There are times when the Court has ruled to prolong this provision because it has not been ready for final judgment. But given the priority of this subject, I hope that the final decision will be before May 28,”, Krasniqi declares.
The Constitutional Court's interim ruling on President Hashim Thaci's decree, Krasniqi says it is a common practice on the part of this court, under which such a move was even when it was elected mayor in 2014, Isa Mustafa.
However, according to Krasniqi, this decision yesterday by the Court also contributes to the reduction of political tensions.
This measure aims to prevent the judicial impact of this decision, because it could happen that laws that would be approved with government sponsorship, with salaries being made by these officials. Then, entry into contractual relations between international agreements by the government. Thus, all of these would have legal consequences, and for this reason the Court has taken a measure that also suspends the course of deadlines. While, the 15th day now should be the deadline until Avdullah Hoti would propose the new government cabinet is now suspended and does not flow. And through this decision, the incumbent Government of Albin Kurt remains until this court fails to come up with a new decision. The whole measure also contributes to lowering tensions that have been created between political subjects and thus allows a space for these subjects to accept a final act coming from the Constitutional Court”, Krasniqi declares.
Analyst from Democracy Plus has commented on this court's next decision on Kosovo Government, on the quarantined proclamation of municipalities, in this case Prizren's Dragas and Istog, due to complaints he has filed with PDK.
Krasniqi says the government and municipalities must implement the Constitutional Court's judgments, as it becomes a double violation.
It's very bad that the government has made anti-covenal decisions and the worse when these decisions have only tried to re-pack the same shape and content of the effects that these decisions have had. The government needs to understand that the decisions made by the Constitutional Court are final, they cannot be complained about, and it is constitutional violation as well as disrespect of the Constitutional Court's judgments, so it becomes a double violation. Political parties, which are involved in conflicting cases at the Constitutional Court, must put aside threats and pressures on this court, but respect its decisions as they have been taken in their favour or not. What municipalities have to do is to implement those judgments, which were taken by the Constitutional Court, immediately, in terms which are set for”, he says.
While municipalities that are still quarantined for the western spread of the coronary are Pristina, Klina, Malisha and Ferizaj.
