Will they accept the Constitutional decision if they don't fit in, speak by VV

There are still 11 days until the Constitutional Court can come up with the decision about Vetevendosje Movement's request, which believes President Hashim Thaci's decree for mandate of the LDK's Avdullah Hoti -- as the second party -- is unconstitutional and that the election proclamation must occur. For Albin Kurti's party, this is the only option.

Even though incumbent Minister Albulen Haxhiu, who comes from the ranks of Vetevendosje, does not speak explicitly about whether her party respects any Constitutional decision, Prime Minister Kurti makes clear that any decision that is not like The LVVA is waiting for him, would be contrary to the Court Constitution itself.

Prime Minister Kurti, when you asked what if the Constitution gives the other side the right -- Hot's mandate -- he says that “you cannot imagine” how such a decision would be written.

I'm super curious to see how such a decision will be written. I cannot imagine how such a decision would be written without being in conflict with the Constitutional Court itself and the Constitution of the Republic of Kosovo. There is no longer a republican and democratic order in Kosovo, if it is accepted by the president's decree to sign the Constitution”, Kurti said on Saturday in T7.

Will the Constitutional Court really respect its decision, even if it does not?

Vetevendosje's Media Office says its party in the past has accepted decisions even when it has been favourable. But according to VVU, those decisions that are also contrary to previous Constitutional decisions cannot be accepted.

In the past we have accepted the Constitutional Court's decisions even when they were against our stand. But, a Constitutional Court ruling cannot be accepted, which opposes the Constitutional Court's own earlier decisions on the same issue. The law and the constitution cannot be implemented by two standards. Not in a democracy”, says the response of LVVA.

The 2014 Constitution Act on the political scene does not read the same judgment on who has the right to rule the parliamentary majority, or only the party that comes first in the elections.

Chief Prime Minister Vjosa Osmani has refused to prejudge the Constitutional Court, while she believes in the professional integrity of the Constitutional Judges.

I'll only be able to answer when we have that bias. I believe in the professional integrity of these judges. The moment we have an answer from the Constitutional Court, everything else would depend on that reply”, Osman said.

The LDK's top official, Arba Abrashi, has told Gazeta that respect for the Constitutional Court's judgments is the fundamental principle of European democracies, and according to him, LVV is expressing doubts in respecting a possible Constitutional Court act.

And we're talking about a fundamental principle of democracy, and these days, the statements of VV officials unfortunately show speculation about respecting the Constitutional Court's decision to term Hoti”, Abrashi has said.

“What I can say is that those who do not respect the Constitutional Court as a organ do not respect its judgments, simply show that they are acting outside the constitutional order, and thus seriously damage the Constitutional system, and the state of Kosovo”, the member of the LDKCE's leadership has said.

Politologist Fitim Salihu has said it could not be ruled out by a negative response from the VV) if he dislikes the Constitutional decision, although, according to him, it is unfair to prejudge the behaviour of this party.

The same as it is unjust to prejudge the Constitutional Court's decision, it would be as unfair to prejudge Vetevendosje's behaviour against that decision. However, given the past, a negative response on the part of Vetevendosje cannot be ruled out, which has so far reacted to the GK's decisions selectively. Whether they have converted it or not, Vetevendosje has once praised and rejected those decisions”, Salihu said.

For the politician, the fact that Prime Minister Albulen Hadziu, who heads the Dicster of Justice in Government, has refused to claim that he respects any decisions of justice institutions.

“I hope that Vetevendosje will show signs of maturity from a normal party. This party and its leader must learn to behave institutionally and constitutionally. Otherwise, it must be alleged that it is tragic when you hear a justice minister refusing to state that he will respect the justice bodies' decision. When the justice minister (or prime minister) himself does not respect the decisions of the justice bodies, how can you convince a simple citizen to implement them?

Minister Haxhiu has refused to respond firmly if her party respects each Constitutional decision.

Very difficult question... However, I'm saying I can't answer yes or no, because I always prefer to talk about content”, Minister Haxhiu said.

Challenged if respect for the Constitutional Court's decision is being questioned, she has again said that she cannot answer yes or no.

No, but it is very formal to ask for an answer with yes or no. I'm explaining several times, everywhere, all our legal arguments. Now it doesn't help the Constitutional Court to decide otherwise and to decide otherwise”.

A protest has been warned in the country, with which activists demand that the country go to the polls. The same demand has the Vetvvendosje Movement, though this party has denied that it has called any protests, or evidence of protest, where about 400 people gathered in Pristina Square last week.

President Hashim Thaci has mandated the LDK's Avdullah Hotin to form Government after considering that LVV has not responded to his request for a new name proposal for prime minister, following Albin Kurti's ouster on March 25th.

After publishing the president's decree for the mandate of Hoti, the Vetevendosje Movement has handed over to the Constitutional Court this decision by Thaci, considering it has bypassed Kurti's party as the winner of the 6 October elections.

The Constitutional Court has suspended the president's decree and is expected until May 29th to come forward with judicial action over this issue.
