New Prime Minister: The LDK has still sent the name of Avdullah Hoti to the Presidency

Last Thursday, Hashim Thaci as head of state has launched a letter in the direction of Isa Mustaf, asking for the candidate name for prime minister. The letter has yet been made public, while the President's Office has only confirmed Thaci's request in the direction of LDK) chairman.

Meanwhile, the LDK has still submitted its name to the Presidencys to then receive the president's decree for the nomination of Avdullah Hoti for Chief of the New Government.

The Vetevendosje movement is seeking to see the letter ready for constitutional protection after the president decides to give the mandate to the second party.

However, either the presidency or the LDK have not given Thaci's letter addressed to Mustafa.

Despite that, the Vetevendosje Movement will only be able to submit the subject to the Constitutional Court after the president's decree for the mandate of the new government, which is expected to establish the LDK with the AAK; NISMAS and minorities.

LDK Deputy Chairman Lutfi Haziri has said that if the Government's formation subject ends in the Court, then they will wait for the decision and then form Government.

There are no violations of the Constitution after my belief. There is no case in court without happening without reason. If Vetevendosje or the president of the Republic sends the council to the Constitutional Court, we expect”, said LDK deputy chairman”, Haziri said.

The Vetevendosje movement has refused to submit its name to the new government chief following Albin Kurti's dismissal from the prime minister's position, with the votes of 2/3 of MPs.

Vetevendosje's chief has insisted on moving to the elections and remaining in the prime minister's position until the pandemic passes.

The chief of the dismissed government has said parliament must be distributed while the president should only set the election date.

Enver Hasani, professor of law and former head of the Constitutional Court, has said the Kosovo Parliament can vote on the new Government whenever there is political will. But, he has said that the pre-priced procedure with the Constitution envisions the mandate being given first to the winners and then to the one who sends the country to elections.

“Therefore Article 95 regulates all possible situations and is command of the government formation process. For the specific case in which the country is located, there is Article 95.5. of the Constitution. Never another article. That's because, within an election mandate, a Assembly could form three, four, five or more governments, always having the winner of the election” at the helm, Hasani said, days ago when he was asked about the constitutional procedure of forming the Government.

Albin Kurti was dismissed from the prime minister's position without filling two months with a motion initiated by the Democratic League of Kosovo.

Kurti had initially accepted the LDK's request to remove the tax and not impose reciprocity with Serbia and then dismissed Agim Veliun from the interior minister's position, with which he ended staying at the head of the government.

The president has warned last week that there will soon be steps for forming the Government and removing reciprocity with Serbia to start dialogue with Serbia. Ambassador Richard Green had immediately responded, giving support to this initiative.

After that, there have been warnings from the VV that there will be resistance not to allow Kurti's departure from the prime minister's chair.
