OECAK, OEK call for abolishing Telekom decision

In this regard, the American Oda and the Economic Oda of Kosovo express their concern over the government's decision in office's exclusion from the Public Procurement Law field, the telecommunications services Kosovo Telekom offers as services of particular state importance, with the government in office being directly violating legal and constitutional provisions for equal treatment of public and private enterprises.
The licensed private contractors have the same rights and obligations as all other public operators, so in this respect their ed and their treatment should be undiscreet, and this is clearly regulated by the Public Procurement Law, which forces contracting authorities to treat all economic operators equally and prevents them from carrying out any activity that reduces it, and much less eliminates free competition. The violation of the principles of free competition has already been confirmed by the Kosovo Competition Authority. The ongoing practice of misinterpreting Article 9.4 of the Public Procurement Law has violated private operators' operations by damaging them financially and risking their existence by conveying a bad message to foreign investors. The American Oda and the Economic Oda of Kosovo recall the incumbent government and other institutions of the Republic of Kosovo that these private operators through their continued investments have influenced «the creation of new jobs as well as the delivery of quality services”, said the communiqué.
Reminding the institutions even of their commitment to respect constitutional and legal provisions, the American Economic Oda in Kosovo and the Economic Oda of Kosovo require the abolition of the decision in question, refraining from decisions that favour certain companies regardless.
