Periscopi notes that the Kosovo presidency will file criminal charges against outgoing Prime Minister Albin Kurti, due to measures presented today by the Ministry of Health, led by Arben Vitita, who last night, Kurti delegated the competencies for decisions related to further invisibility of COVID 19. This, as government on the run Kurti, has continued to ignore the Constitutional Court's recent decision to violate human fundamental freedoms.
Among the measures Kosovo Government has presented tonight, respectively, includes restricting freedom of movement, where citizens have no right to leave home and residences, more than an hour and a half a day. But a decision of March 23, 2020, where the measures applied to this day included freedom of movement, the Constitutional Court unanimously ruled that it constituted serious violation of fundamental freedoms.
According to Article 116, paragraph 1 of the Constitution of Kosovo is determined that “Constitutional Court decisions are binding for the judiciary and all persons and institutions of the Republic of Kosovo”.
While Article 394 paragraph 1 and 2 of the Kosovo Criminal Code stipulates that “1. The official or responsible person who refuses to execute the order, ruling or the almighty act of court of the Republic of Kosovo, or who does not execute the verdict within the legal deadline or deadline of the verdict, is fined or sentenced to imprisonment of up to two (2) years. 2. If by criminal action in paragraph 1. this article has caused serious violation of human rights or substantial material damage, chief sentenced to imprisonment of six centuries to five (5) years”
