Arian Elshani, representative of The PDK at the Central Election Commission has commented on its social network for the efforts of Kurti and representatives of the Vetevendosje Movement to interpret the Constitution on their own merits and interests. According to him, they are giving themselves the attributes of a constitutional court, while themselves are consecutively fourfold violators of the constitution.
In his post on Facebook, he listed four violations of the Constitution that are the two decisions on the restrictive measures of fundamental freedoms in the case of the Coronavirus, the minister's decision on the emergency package exceeding the assembly, as well as the decision on telecom that violates the principles of the market economy protected by the constitution. Therefore, Elshani points out that Kurti and his party officials should show regret rather than speak with great confidence about how the constitution should be interpreted in the case of the president's actions.
Elshan's full social networking post:
By what right is the dismissed Prime Minister Kurti and the representatives of the Vetevendosje Movement sold as supreme authority to interpret the Constitution of the Republic of Kosovo, when four times in a few weeks they violated it? For many days we have heard them talking on screens about how the constitution should be interpreted and pressuring the president on how he according to them should act. So they are giving themselves the attributes of a constitutional court while themselves are consecutively fourfold violators of the constitution.
The 1st violation, they did on March 23rd 2020, with the government's decision on measures limiting freedoms. The Constitutional Court has already handed down the verdict on the case, presenting it as a violation of the Constitution that had restricted fundamental rights and freedoms guaranteed with the Constitution.
The 2nd violation was on April 2nd, when the fired minister Bislim approved an illegal emergency package, given that the Constitution recognises only parliament as the institution that has the committee to decide on the budget.
The 3rd violation was the Government's outgoing decision to abolish the procurement procedures for Telekom, transforming this company into a state monopoly following the appointment of the board of party militants, and through the market economy and free competition guaranteed by the Constitution.
The 4th violation was the decision by the dismissed minister of Vitita, through the new decision on anti-Koronavirus measures, again violated not only the Constitution but also the Constitutional Court's act.
So 4 successive violations and the dismissed prime minister, not only does he not repent but he has the indiscretion to speak all “-trust” how the constitution should be interpreted. Today, this four-fold violator of the Constitution and his party have at least a moral right to talk about interpreting the Constitution.
