The Appeals Court has decided to retrial the case against Enver Sekirras, charged with inciting the assassination of former police officer Triumf Riza.
The Special Department of the Appeals Court, having approved the supporting side complaint, has turned the prosecution's E.S. case into retrial. He was convicted on the part of the Constitutional Court in Pristina last month for criminal work “Postponing to commit a capital murder” by Article 24 and 147 par.3 and 9 of the Kosovo Criminal Code, the case had been sentenced to a unique sentence for 30 years”, the Court's announcement said.
The three-judge college of this court found that the complaint court has been brought against the provisions of Article 384 of the Criminal Procedure Code, because the first degree court has ignored the provisions dealing with judicial review.
Sekiraqa, in September last year, was convicted of inciting the murder of the late Riza, for which he had been pronounced a 30-year term sentence.
