Thomas Thabane would have to be charged with murder Friday, but the 80-year-old did not appear at the hearing in Maseru, the capital of this small mountain kingdom, saying he had to travel to South Africa for medical treatment.
On Monday, however, Thabane sat down in the public part with his second wife, while his lawyer, Qhalehang Letsika, argued that the murder charges against the prime minister froze a significant constitutional issue that had to be resolved before charges were read against his client, writes The Guardian, translated in Albanian Periscopi.
Pethhise Montanyan magistrate admitted that the case was referred to in the Supreme Court.
Lipolelo Thabane, 58, was shot several times in the vicinity while sitting in her car dividing the house two days after her husband was inaugurated as prime minister in 2017. She reportedly refused divorce and had won the battle in court to obtain the privilege of being the first lady until the formal separation from it.
Thomas Thabane was married two months after her death. His second wife, named Maaseiah, 42, was charged with murder this month as well after leaving the country briefly. Both had denied any involvement in murder.
Prime Minister Thabane has said he would resign at the end of July.
