The Vetevendosje movement says the Kosovo Constitutional Court's decision, in terms of the ban on persons convicted to participate in the elections, will have no impact on the election run by the party's leader, Albin Kurti, and leadership member Albulen Haxhiu.
In the December 21st decision, the Constitution said the Kosovo government, led by Avdullah Hoti, had been elected unconstitutionally after voting for Etem Arifi, against which there was a firm degree for criminal work “subsidies”. He is sentenced to one year and three months in prison.
The Constitution argued that no person who is convicted of criminal offence with a firm form judicial decision in the past three years could be a candidate for MP, nor win a valid mandate in the Assembly of the Republic of Kosovo”.
“Constitutional Court Act, item 2 of this act has linked Article 29 of the Law for General Elections to Article 70.3 of the Republic Constitution, namely, cases sentenced to one year and more imprisonment. In our case, in Mr. Kurt and Mrs. Haxhiu, they have not had prison sentences, but parole sentences, and parole sentences have no legal effects, respectively. So Chairman Kurti and our chief member, Mrs. Haxhiu have no stop to be part of the” election race, LVV spokesman Korypziou told Radio Free Europe.
In 2018, the deputies of the Vetevendosje Movement, Albin Kurti, Albulen Hadziu, Faton Topalli and Donika Cadaj-Bujupi were sentenced on bail for throwing tear gas into the convent's environments.
Meanwhile, Ehat Miftaraj has considered it a big “ ” part of the Constitutional decision, which says that persons sentenced within 3 years were banned from running in elections.
According to the Kosovo Constitutional Court's decision, Albin Kurti, Albulen Haxhiu, Donika Cadaj-Bujupi, Faton Topalli, and many others convicted of criminal acts, will not be able to run in elections to be held in January or February of next year”, Miftaraj wrote on Facebook.
