Specialized modes operate without anyone's influence and interference, political or any other. Specialised rooms and judges are independent, do not act on anyone's instructions, and are directed only by law. All three managers and all judges. Any violation of this obligation, although I don't believe it will, will undergo relevant disciplinary mechanisms”, Trendafilova said in an interview for the Serbian medium “Politika”.
She said that in The Hague, the “a take their oath very seriously and, as judges, are determined to protect the integrity of procedures and maintain their independence and impartiality”.
Trandafilova said there are attempts to undermine the legitimacy of the Specilla Court, but according to her, this court will only address its mandate.
“There are attempts to undermine the legitimacy of the DHSK, but they are not new and will certainly last as long as this court exists. We will not engage in any political debate, but we will deal with what is the mandate of The DHSK, and this is to ensure justice”, she added.
The Special Speaker adds that the public, “including the Serb, will be able to conclude for themselves whether the DHSK has fulfilled the role entrusted to it by its mandate”.
I believe that the work of the DHSK, ordinances and decisions will speak for themselves. In this direction, The DHSK is trying to make sure that the public is informed accurately, in due time and in a transparent manner”, Trendafilova said.
Asked to comment on the prevailing public opinion that the work of this court is influenced by international interests and orders, mainly by the United States, and that the charges are part of a future compromise regarding Serbia's recognition from Kosovo, she said:
“D The KSF is a judicial institution, not a political institution. We don't follow anyone's instructions. It is a court founded in line with the agreement ratified by the Assembly of Kosovo and focused exclusively on conducting secure, fair, impartial and independent procedures”.
Trendafilova says the safety of victims and witnesses who appear before the Special Court is of great importance.
For this purpose, there is a specialised service in the DHSK, whose task is to provide protection and support to victims and witnesses, money, during and after trial. To protect them, their activities are strictly confidential. Judges could order safeguard clauses during the trial, such as erasing names from the registers, installing nicknames, applying a measure of character change or voice, and issuing orders to testify at closed or half closed session”, the Special Court head said.
