Mustafa versus Constitutional: I can't make a choice.

The head of the Democratic League of Kosovo, Isa Mustafa in an interview has said that the Constitutional Court's decision to oust the Hoti Government based on convicted MP Etem Arifi's vote has been unfair and not professional. Mustafa said Arifi has also voted Kurti Government and the Parliament's Headship, but no one has been taken into account.
However, Mustafa says they will respect this decision, even though it is considered harmful to the country.
He even says that the Constitutional Court has no right to proclaim elections and that whenever the thought is being asked, it is writing parts of the Constitution that do not possess it.
“We have not expected at all that the Constitutional Court will come up with such a decision because measures have been taken and no long-term legitimacy to MP Etem Arifaj has been alarmed. He has been elected deputy to this mandate. The work for which he was convicted belongs to past legislation, and therefore he has made the mandate in past legislation. He has participated and voted for all the bodies that have emerged from last October 6th elections last year, even for the Parliament's Headship of the Parliament and for the government of Hoti and Kurti Government, and no one has signaled that he has no right to do so. And now it's only about voting the Hoti government. You will be left on the sidelines of the votes for the remaining”.
I think it's an unreasonable concentration of the Constitutional Court if the Constitutional Court has ascertained that it has not had a mandate from the beginning because it was convicted then it should be mandated by the mandates of 120 deputies and remains that the government has still voted with the majority of MPs, and I see no constitutional reason for the Constitutional Court to announce the elections. It's not in the mandate either of the Constitutional Court to announce the elections. It may expose weaknesses or legal concessions that have occurred, but it is not what declares the elections. I don't think it was fair or professional.
But I do not now contest the decision as such because we have expressed as the LDK that will accept the decision and act accordingly. But I think that such decisions do not benefit the country because no court in Kosovo should appear and behave as the supreme body of the state of Kosovo, and then it shares justice because it is the Constitution that has defined the rules of conduct and cannot the Constitutional Court in any case write part of the Constitution as it is happening to us”.
Mustafa highly recognises the governance of Prime Minister Hoti, adding that he has governed in a serious period as regards the management of pandemic and the fight against corruption.
Therefore, according to him, Kosovo needs Government, which respects both the Constitution and the laws.
I think the Hoti Government has run well. But I am also convinced that it has governed in a period of totally serious because there has been a majority coalition sometimes in the absence of a majority separately from the period that MP Arifi has been arrested before but has worked hard on the management of pandemic and the fight against pandemic. It has produced very good results in international communication because communication with the United States has been restored. But for six months it is impossible to do any extremely big work that will mark an era of Hoti government, but what I have seen as Mr. Hoti as prime minister has worked with full conscience. He has not been named as a prime minister who has committed violations either of the government. Therefore, we need this government which respects both the Constitution and the laws of Kosovo”, Mustafa told EO.
Mustafa says that international agreements must be approved and ratified before moving to elections.
I think it's a big risk. If the budget is not approved and in this case appeals to all political subjects to mobilise them and call a House session before the election declaration so that the budget is approved to ratify international agreements that are related to the future budget. And once that's done, we're all against going to the polls so that the President's task was to announce them and the country go to the election”.
