Social Democrat Initiative Chairman Fatmir Limaj says he has not expected the Constitutional Court's decision that opened the way for elections by overthrowing the Avdullah Hoti government. With this decision, according to Limaj, who is a lawyer by profession, the Constitution took on the role which the Constitution belongs to, declaring convictions.
As a lawyer, I find it difficult to have a legal rationale why the government's rule of choice has a backlash effect and there is no reverse effect on the decisions of that government. I have a problem as a lawyer to reason on this. It's going to take retroactive in all or giving me actions on what needs to be done in the future, what should not be done in the future, and second that it's a question to me: I'm under the impression that in one case the Constitutional Court has taken on the role which is due, has declared sentence. The only institution for citizens, the only institution in Kosovo by courts, is the Constitutional Court, which does not declare sentences, does not condemn. The Constitutional Court does not address the sentences, it is fair courts, from the Foundation to the Supreme”, Limaj says for RTK.
With the very fact that the Constitutional Court says: The one who has been convicted for up to three years with a firm court justice has no right to be re-elected, it's condemnation, it's a punishment, because you deprive someone of the right, and that's not the authority of the Constitutional Court, that's the right of fair courts”, Limaj explained.
