The Constitution has found that, under Article 71.1 of the Constitution of the Republic of Kosovo, in contact with Article 29.1 (q) of the General Election Law, the person convicted of criminal acts with a decision of firm form in the last three (3) years cannot be a candidate for MP, nor win a valid mandate in the Assembly of the Republic of Kosovo.
She also found out, no. 07/V-014 of Kosovo's Parliament for the Election of the Government of Kosovo, June 3, 2020, is not in compliance with Article 3 of Article 95 [The Government's election] of the Constitution, because the government has not received the majority of votes of all Kosovo Assembly deputies, and given that the Government has not been selected according to Article 95 [the Government election] of the Constitution, then supported in paragraph 4 of Article 95 [The Government], the president of the Republic of Kosovo, which should be held late than 40 days after their proclamation.
But when might the date be held for the extraordinary elections?
From the presidency last night following the Constitutional decision have indicated that President Vjosa Osmani's U.S. will today invite parties for consultations regarding the date.
According to Eugen Cakoli from KDI, this means that elections are due to January 24th, 2021.
“If U.D. The president's decree to hold early parliamentary elections is announced tonight or tomorrow, most likely, that elections will be held on January 24th of next year”, Cakolli said.
