The Centre for Strategic Judicial Cases (CSL), the platform founded by the Group for Jury and Political Studies (GLPS), holds a media conference on the occasion of handing over the indictment for failing to establish the Law for Tobacco Control and Human Rights Against the Ministry of Health and the Office of Kosovo Prime Minister.
The Centre for Strategic Judicial Cases will submit indictments against these two public institutions due to the non-invention of Law No. 04/ L-156 for Tobacco Control, which specifically stipulates that smoking is banned in public places in Kosovo.
According to the Law on Tobacco Control, public places in which smoking is prohibited include closed places such as maids, which have a mobile roof or not, and which are surrounded by two or more sides, regardless of the material used and whether it is permanent or temporary.
Despite that, the Tobacco Control Law finds no application in Kosovo, and this constitutes a failure of public institutions to implement it, which endangers the health and life of citizens and constitutes violations of their fundamental rights, especially of citizens who have asthma or other chronic diseases.
Disinvention of laws in Kosovo such as the Law on Tobacco Control creates no respect for public institutions, rather it creates deep distrust and disregard for them, as well as damaging legal security in Kosovo.
Therefore, with this indictment it is intended to become full implementation of the Law on Tobacco Control and to protect the fundamental rights of Kosovo citizens.
