Defence calls for throwing charges in case Ikballe Berisha is accused of pushing terrorism

In a second review of accused Ikball Berisha-Huduti for pushing to commit terrorist acts, her defence has demanded that the indictment against him be dismissed while the prosecution has rejected it.
The Special Prosecutor of the Republic of Kosovo (PSRK) is accusing him of calling for revenge against American authorities who had carried out an attack in Iraq, where the general and leader of Iran's revolutionary guard, Qassem Soleman, had been killed.
For these actions, Berisha-Huduti is being tasked with criminal work “Push for terrorist activity”.
Charged Berisha-Huduti, through her defence, Kosovo lawyer Kelmendi has written down the opposition to the indictment exercised by the Special Prosecutor of the Republic of Kosovo.
Regarding the indictment's opposition has been responded to by special prosecutor Africa Shefkiu, who at Thursday's session, has proposed that the request for the dropping of the indictment be refused as unfounded and continue with the trial.
This, with the reasoning that the actions of the accused in the sense of calling for revenge against the American Army, by describing in detail the reasons and limits of the call for revenge, constituted criminal acts involved in the 14th chapter of the Republic of Kosovo's Criminal Code as pushing to carry out terrorist acts, reports the “Bettim for Justice”.
In this regard, lawyer Kelmendi has said prosecutor Shefkiu's comment on calling for revenge is the perception of his interpretation, while elaboring defence elements in the request to drop the indictment are cytates from the commentaries of the Republic of Kosovo's Penal Code and presents in an extensively what the push means.
The defence has considered that we have nothing to do with calling for revenge, but neither with a reconciliation of an eventual terrorist ideology.
Prosecutor Shefkiu has stated that with the analysis of communications issued by the accused's phone and her communications on social networks, there have been comments and photos of the Iranian general's murder and the hatred he has for Americans, where he accuses the same people as a murderer and calls out for outright revenge on this murder.

Afterwards, lawyer Kelmendi has argued that dominant personalities have expressed perhaps even tougher thoughts about the murder of Iranian general in terms of content and have not been described as driving for terrorist acts.
She has handed the court a post by portal “Kosova Sot” in which political analyst Fatos Lubonja had named the murder of Iranian general an act of terrorism, as well as Philip Gordon's opinion, which he said was American and that he also named this murder a terrorist by saying revenge is expected.
Protection of the accused Berisha-Huduti has said that expressing a guaranteed free opinion with the Constitution cannot be considered calling or pushing for terrorist acts.
While the accused Ikball Berisha-Huduti himself has said these charges have influenced her reputation by being considered terrorist, and, as a result, she is unemployed.
Following statements by the parties, the chairman of the court, Albina Shaban-Rama, has said the decision concerning the controversy of the indictment will be taken out of the hearing and the parties will be announced in time.
According to the indictment compiled on September 30th 2020, accused Ikballe Berisha on January 4th 2020, via the social network “Facebook”, had posted calls with threatening content, inciting revenge after the U.S. Army of Qassem Soleman-general and leader of Iran's Revolutionary Guard and General Ebu Mehdi Mujendis.
The Iraqi people reportedly posted the text “on Iraq's streets immediately after the American crime, to strongly condemn the injustice the two dominant figures in Iraq and Iran to their two generals General Sylejmani and General Abu Mehdi Muhendisi. For this post, The PSRK is claiming that the same had caused the risk of one or more such acts being performed.
PSRK accused Berisha is charging him with criminal activity “The push for the conduct of terrorist acts”, from Article 134 of the Republic of Kosovo's Penal Code.
