Daka: The presidency should ask the CEC for another name instead of Arifi

Following MP Eem Arifi's prison sentence, Central Election Commission Chairman Valdete Daka, has indicated the procedures a person must conduct, who is running for deputy in the Kosovo Assembly.

Daka has said that the CEC does not confirm the records of the individuals, including whether they are convicted of any criminal offense.

“An individual who is running on behalf of a political subject in parliament must first complete a form, all information written there must be true. He or she signed under moral and criminal responsibility confirms that anything written on that form is true”.

“The CEC does not verify that form, because it considers that these people have given all the correct answers. The possibility of verifying these applications from the CEC exists when someone draws attention to a candidate about not telling the truth”.

“The CEC can decertify that person, who has not met the conditions of Article 29 of the Kosovo Constitution. In the concrete case of Etem Arifi because of the Supreme Court's decision, the CEC has been unable to proceed further. So to verify the candidates, with this decision of the Supreme One practically Article 29 is depreciated”.

Daka has indicated that because of a Supreme Court ruling in the 2019 parliamentary elections, The CEC has not asked the Judiciary Council for information on whether candidates for MPs are sentenced to prison.

“In 2017 The CEC is wanted by the Judiciary Council to send us all the candidate judgments. It has turned out that a large portion of the candidates have served prison sentences of”.

We haven't even addressed the Court in 2019, because we considered that it was once decided by the Supreme, we couldn't do the same action again as 2017<18x1>.

Daka has stressed that the CEC can propose an MP instead of Etem Arifi, when the Kosovo Presidency demands him.

“Etem Arifi received an MP's mandate in 2019, at the moment he is sentenced to prison and is serving his sentence. According to all odds if an MP is not in the Assembly for six months for no reason whatsoever, the Parliament requires the presidency to make the replacement of MP”.

The presidency then requires us to show the name of the person it should be for MP”, Dhaka said.
