Smith had initially expressed fears that the former president of Kosovo could escape after the unconfirmed indictment had become public. According to him, this would move Thaci to flee.
Smith had also in his letter claimed that Thaci could commit other crimes and hinder special procedures. While predicting that the charges confirmed by the Specialised Chambers could bring life in prison for the former president.
As long as certain and general data regarding the submitted and unconfirmed indictment has been published, Mr. Thaci for escape, to prevent proceedings and commit further crimes, will grow dramatically as soon as he is informed of the confirmed indictment and of the details of the confirmed charges, which could bring life sentence”, says the document that Jack Smith sent to the Judge of Pre-Procedure Procedure.

On this letter is the insistence of Chief Special Prosecutor that Thaci should be arrested and sent to custody.
