Special Court continues mandate, reject Thaci's proposals

Kosovo President Hashim Thaci officially addressed the Kosovo Parliament's Headship on 25 August with proposals for the Constitutional Amendment for extending the mandate of Specialised Chambers and the Specialised Prosecutor's Office in The Hague. Thaci in his proposal sent the Parliament's Headship, has sought to change the amendment's article, where it says the term of this institution will last for a period of five years.

November 2020, the Constitutional Court's Specialised Chamber (Central Chamber) issued its case on reference to proposed amendments to Article 162 of the Kosovo Constitution
( For Specialised Chambers and Specialized Prosecutor's Office. The Constitutional Chamber ruled that the proposed constitutional amendments diminish the rights and freedoms guaranteed by Chapter II of the Constitution.
Constitutional amendments were proposed on August 24th 2020 by the then president of Kosovo, and following the Kosovo Parliament Speaker forwarded them to the Chamber for preliminary assessment, in line with the Constitution's Article 14450. In its act, the Constitutional Chamber praised the proposed constitutional amendments, paying due attention to the context and specific features of the Specialised Chambers and the Specialised Prosecutor's Office.
The Constitutional Chamber also confirmed that, in accordance with Article 162K3 of the Constitution, this Chamber has exclusive jurisdiction for conducting this assessment, since the proposed amendments are related to the Specialised Chambers and the Specialised Prosecutor's Office. Similarly, the Constitutional Chamber stressed that, in accordance with Article 162%13) and (14) of the Constitution, the mandate of the Specialised Chambers and the Specialised Prosecutor's Office has continued and will continue until the European Union Council announces the outcome of their mandate.
