In the prosecution's request for the Pre-Procedure Court in the case of Salih Mustaf, it is said it should continue to remain in custody as the only way to manage the risks posed by the accused.
“in general, the risks posed by the release of the accused, considered only or together, can be effectively managed only at the Pre-burg Centre. Jailing is the most effective way to limit the accused's ability to escape or otherwise to prevent specialised rooms from achieving its judicial achievement, preventing investigation or judicial procedures, and / or committing further crimes. Any assurance that the accused may give would be insufficient to guarantee compliance with any conditions or to overcome the concrete dangers of release. Under such circumstances, the release, by or without conditions, should not be allowed”, says the Special Prosecutor's request for Prosecution Judge Nicolas Guillou.
The fact is that for the reasons listed, the specialised prosecutor requires accused Salih Mustafa to remain in custody.
Salih Mustafa's defence has filed a request before the judge of the preliminary procedure for him to be released from custody.
The defence request reportedly says Salih Mustafa is a Kosovo citizen who has residence in Kosovo and how much he has co-operated with the Specialised Prosecutor's Office.
Under defence, there is no basis for the accused to conduct any incidents if released and that Mustafa will stay home with his family.
