Lawyers say raids by special investigators are taking place against the rules

As soon as they were arrested and sent to The Hague, former Kosovo President Hashim Thaci, former PDK leader Kadri Veselini, and MP Rexhep Selimi, investigators of the Specialised Chambers conducted raids on their homes. This, according to attorneys licensed to defend cases at the Special Court, is considered contrary to the rules. The raids by investigators [...]

The raids by investigators from Specialised Chambers in former President Hashim Thaci's settlements, former PDK leader Kadri Veselini, MP Rexhep Selimi, are considered to have been carried out outside the rules, by lawyers licensed to defend cases in this court.

Lawyer Artan Qerkeyni says the raid must be carried out before the arrest of suspects occurs.

When an indictment is confirmed, it suggests that the investigation phase is complete. So the procedure company, not in accordance with the phase of the procedure in which the criminal case is found, constitutes legal violations and, therefore, all the eventual evidence provided by this action could potentially be declared unacceptable evidence”, Kerkey said in a televised debate.

The document tells of an occasion when a client has been committed procedural violations, and after his complaint to the Constitutional Court, the prosecutor has withdrawn.

The complaint was approved in February 2019, and the prosecutor subsequently issued an order, meaning procedural violations are present, neither the prosecution nor the court are immune to them”, Artan Kerkin further stated, records the Telegrafi.

And the other attorney licensed by the Special Court, Kadri Oye, says that there have been ongoing encounters of specialised Chambers that have been contrary to the law.

The “continued to face this court in actions that conflict with the law, especially the cases of the detention, even though with the Law for Specialised Chambers with the Constitution of Kosovo, with the European Convention on Protection of Rights and Freedoms, the parties should be given access in a procedure as short as they can provide arguments concerning the privatisation of freedom”, Kadri Oye said.

Unlike Thaci, Wessel and Selimi, former spokeswoman UCK's Jakup Krasniqi was arrested after the raid ended.
