Even if the Constitutional Court decides that MP Etem Arifi has lost his mandate before taking part in the Hoti Government vote, it cannot cancel the decision of the Parliament in which he participated through the vote.
In the case that the Constitutional Court had concluded that the election of Behxhet Pacolli had been made contrary to the Constitution, the Court had not made a retroactive decision but that the decision had entered into force on the day of publication.
Thus, the Court has not annulled Pacolli's decisions, which it had made in the president's quality, despite his being elected contrary to the Constitution.
