MP Adem Hoxha acquitted of assault and deportation

The Constitutional Court in Prizren, the branch in Dragash, on Friday, has acquitted the Kosovo Assembly MP -- once chairman of the United Party Gorane, Adem Hoxha -- of assault and rowing.

According to the trial pronounced by Judge Luan Berisha, it has not been proven that defendant Hoxha has committed criminal acts that he is charged with.

Judge Berisha stated that after analyzing and evaluating all the evidence presented, the prosecution and the injured have failed to prove the guilt of accused Hoxha.

The damaged side has been instructed in the right to complaint, after taking the case in writing.

Before declaring the indictment, final words have been given at Friday's hearing.

His final word, the prosecutor Besha Shala, has delivered in written form, where the same is translated to the official language of the parties, on the part of the court, in which the sentence of the accused is sought, reports “Justice Vought”.

In addition to staying on a whole close to prosecutor Shala's speech, the injured Bezat Berzat has said the criminal acts the defendant is charged with during past hearings, for which he seeks the sentence of the same, as envisioned by law.

We're not up in the morning to accuse someone. What's happened to us is real, we haven't felt safe since that day until now, so I consider that the prosecution and we've managed to prove that these criminal acts have occurred”, the victim said.

“Since it's also about a public, political duty, here the accused should be a positive example of our community, not putting pressure and physical attacks, threats to his countrymen and his associates”, the victim has continued.

While the accused's representative, lawyer Hajrep Krasniqi, has declared that the indictment is unfounded, as according to him, during its prosecution the prosecution is based only on the statements of the injured, without taking any investigative action in advance.

According to lawyer Krasniqi, if the injuries had been described in the indictment, they would have suffered physical injuries, certified even with medical reports, reports the “Justice Trust”.

The carefully reviewing the final word of the state prosecution, in which it notes that only with the injured's statement, it claims there has been an attack on exhumation, meanwhile by statements of the injured, in no statement does the fact that my protector of this case has taken place, as described in Dario”, said lawyer Krasniqi.

All witnesses show that there have been verbal clashes on the issues raised, described as tensions, but no witness has claimed that my defender attacked Fatir and the Berzatt”, the lawyer added.

On the other hand, as far as transliterated auto recording is concerned, the same said that from itself the content is clearly understood that its defender is not heard and is not understood to have said the words that are described in the device.

Meanwhile, defendant Adem Hoxha has asked the prosecution to protect him and his family from the injuries of Fatir and Berzat Berzat, also demanding the return of party documentation and assembly.

Otherwise, according to the indictment filed on February 20th 2018 by the Constitutional Prosecutor in Prizren, Adem Hoxha is charged that on November 26, 2017, at the headquarters of the United Party Gorane (JPG), in Dragas, deliberately uses force against the other person, without the consent of that person.

The indictment is said to have taken place that way, that until the injured Berzat and Fatir Berzat, they had gone to party headquarters, where they had first greeted the party chairman, now defendant Adem Hoxha, where he was addressed in the words “does not deserve to greet me”.

Always in accordance with the indictment, during the conversation defendant Adem Hoxha has risen from the seat and has already turned to the injury Berzat “heads out onto the street because you are not a member of the party and you have no right to stay there”.

According to the indictment, the injured Berzat on his way out is kicked back by the defendant and then struck him with fists and slaps on his face and injured Fatir Berzat.

Based on the indictment, by the date, time and place described as the highest, defendant Hoxha, seriously shares the injury to Fatir and Berzat Berazeti, in words, deeds or gestures that it will cause any harm.

According to the indictment, the cano is done in the way that goes on with the words “ty and your brother I have with you gone missing, you've been an example to others, my family is dangerous” and it went on with the words “and your brother will remember who Adam Hoxha is, and he's fucked up, row”, which, according to the prosecution, caused a sense of fear, anxiety and uncertainty.
