Specialised Prosecutor says there will be an indictment within 30 days

Hysni Gucati, who is being held responsible for fear of witnesses, revenge and violations of the secret of the procedure, today in the courtroom has rejected his manner of arrest until he added that he would respond to justice if there were an invitation.

Prosecutor Valeria Bolic said she would hand over the indictment within 30 days.

“We are committed to a quick process, we confirm that the prosecution intends to hand over the indictment within a 30-day period of”, the prosecutor said.

While the defense, Jonathan Rees has asked the judge to release Gucatin on bail, while the process is pending and there is no indictment brought against him.

The procedure has been given time to respond to written objections to the legality of the arrest, while Mr. Gucati is in custody and will remain in custody while awaiting the prosecution's response... I request from you, Your Honor, that you take into account the possibility of making bail for him”, he said.

In this regard, he spoke of Hysni Gucati's state of health and among the conditions he mentioned was the non-approach of Gucat in O's offices. VL- KLA over 100 meters.

But the Secillated Prosecutor's Office demanded that Hysni Gucati continue his detention, since, as the prosecutor said, there is a danger that he can repeat acts that are obstructing justice, for which he has been arrested.

Mr. Gucati has made such statements on the day of his arrest, and there is the danger of repeating or attempting to commit criminal acts again. She said the detention remains necessary at this stage and that the conditions she presented to the defence are not convincing.

The defence had also put forth in writing other requests related to the arrest of Gucati, for which Judge Nicolas Guillou asked the Specialised Prosecutor's Office to respond until October 9th.

In this hearing, the judge read the rights to Gucati, where, among other things, he has the right to be released if the specialised prosecutor does not turn in an indictment within a year.

Hyseni Gucati was arrested on September 25th in Kosovo, under a Specialised Chambers Arresting Paper.

He and the leaders of O VL- The KLA, through media conferences, had stated that in the offices of the organisation an unknown person has brought documents, as they have claimed, are files derived from the Special Court.
