The Constitutional Court in Pristina has accepted the request of the Special Prosecutor of the Republic of Kosovo for the appointment of the detention measure against defendants B.M., S.R., I.R., B.U., S.K., F.P., P.M., A.C., A.F., K.S., A.S., and B.H. Because of the unauthorized crime of import, export, supply, transport, production, exchange, mediation or sale of unauthorized weapons or explosive matter from Article 364 par.2 related to money. 1 of KPRK in connection with criminal work, participation or organisation of the criminal group organised by Article 277 par.1 of KPRK.
The trial of the preliminary procedure following the hearing and analysis of the subject papers found that the Special Prosecutor's request of the Republic of Kosovo for the detention assignment is not based, so the twelve defendants have been appointed the size of house arrest, as defendants can conceal, or alter criminal work evidence, could prevent the flow of criminal procedure by influencing other participants, so the appointment of house arrest measures for defendants is sufficient for ensuring their presence in criminal procedure.
The sides have the right to that decision at the Kosovo Court of Appeals.
