At the Gucatit session, Jonathan Ellison Rees, defender of the OVL-KLA head, has sought bail from his client. He said Gucati yesterday had a term for an operation dealing with his mobility, as he is disabled of war.

Besides, the former fighter of KLA, there are other health problems. He suffers from diabetes, high blood pressure, and asthma.

All these health problems, his protector said they are enough to allow parole.

“Gucati is the father of seven children and everyone lives in the Scytheright area where he was born. Children are between 23 and 34. Gucati is not well, she suffers from diabetes, insulin, and high blood pressure. He has problems even with mobility, because today he had an appointment at the Pristina hospital to conduct an operation to select mobility. He also suffers from asthma”, his lawyer said yesterday at the hearing held at The Hague.

Even though his protector said they could offer a guarantee of 5 thousand euros, that the Gucati will not escape and that he will live at the address that is determined, for the prosecutor of the case, Valeria Bolic was not enough.

His defender even said Gucati will report to EULEX Police as well.

“We can offer a 5 thousand-euro guarantee that he will live in the address he will determine, which will report to EULEX Police and all these conditions together, all of these respond to that risk of escape”, his protector said, adding that his client will stay away from the KLA War Veterans Organisation 100m.

But, special prosecutor Valeria Bolic said his detention is necessary, as according to her, if released, Gucati will continue to publish special documents.

The necessary “Mbets in this phase of Gucati's detention, since there are no new circumstances that can affect the findings that have been given in the indictment. However, in some earlier public statements, Gucati has publicly confirmed that he will continue to make public any information that could be dropped into possession and that concerns the course of this court”, Bolic said yesterday.

The prosecutor's “Office thinks that if Gucati is to be released, he will continue to perform the same work”, she added.

The Express newspaper has also contacted KLA OVL Secretary Faton Klinkaku for the Gucat operation, but he said he had not been informed about the operation. He said Gucati had performed many operations so far.

There have been “Many operations so far, Klink said..

But, French Judge Nicolas Guillou has closed yesterday's court hearing by giving a “promise” to the chairman of the KLA War Veterans' Organisation that he will consider the possibility of his release on bail from custody.

“Z. Gucati, let me say that under Article 51 and 57, I will review your ban, your detention, or at the request of your attorney, or at my initiative”, Guillo said.

Gucati has been arrested by EULEX on September 25th, at veterans' offices in Pristina, with another raid taking place that day. The same day, Gucati was transferred to the detention facility of Kosovo's Specialised Chambers in The Hague.

The same day, KLA OVL secretariat Nasim Haradinaj, who is also facing the Special Court in The Hague, has been arrested.

Against them has been issued for criminal acts against the administration of justice, respectively, for intimidation of witnesses, revenge and violation of the secret of the procedure, preceded in the Kosovo Criminal Code.
