The Constitutional Court Act in Pec, dated October 11, 2020, has been changed.
The defendants have been assigned the detention measure to approach the country, or the designated person.
They're basically forbidden to approach a witness at a distance of about 100 meters, and they've stopped any communication with him for a month. With this decision, the defendants are aware that if they violate this measure, the court could order detention. The Court of Appeals appreciates that even more this measure can be achieved the purpose for which house arrest is being decided, so it also established the framework of Article 177 par. 1, below par.1.2 and 1.3 of the Criminal Procedure Code.”, the media report said.
It was also said that the court considers that from the weight of criminal acts, the way, circumstances and time in which they are suspected to have been carried out, the ban on approaching the country or the person is sufficient to reduce the risk of defendants affecting evidence or witnesses, or even performing any other criminal work.
H.R. The prosecution's suspect is due to alleged alleged criminal acts “Conflict of Interest”, “Falsification of the official document”. And L.B. due to suspicion based on having committed criminal acts “Kestum use of official position or authority” and “Falsification of the official document.” All these punishable according to the Penal Code of the Republic of Kosovo.
