Doubt about functioning of the Parliament, without new government

Constituting the Kosovo Assembly on December 26th is considered sufficient reason to function with parliamentary commissions and plenary sessions, despite the impasses in forming the government. The roadway in which Kosovo is found with a lack of budget for 2020 has brought the contradiction between whether it can, or not the new legislature [...]

That there may be extraordinary sessions, without new Governments, neither does Deputy Speaker of the Parliament deny from the ranks of the Vetevendosje Movement Arberie Nagavci.

Nagavci, in a proposal for Kosova Prees, hopes the next session to be for forming the government, but says how the new leadership will act according to the Parliament's regulation.

I believe that the next session, we will wait and engage as Movement, but also as vice president that the next session will be for the Government's selection. We believe it should be clear that living the will expressed on October 6th by adopting the budget, but also the legislative agenda of a government that has taken on trust from the citizen... we will act entirely according to the Parliament's regulation, we will lead the assembly as head, along with the chairman and other vice-presidents by respecting”, she says.

But fair against that possibility is former LDK parliamentary group chief Avdullah Hoti, who says among other things about Kosovo Press, that the 2020 draft can't be voted into without the new government being established.

“Budget cannot be voted for 2020 without Government being established. It's the government, which brings the 2020 budget to the Assembly. The budget law is like any other law, but even in the Constitution, it says it is the government's competence to bring the budget to the Assembly. This government on duty cannot report this assembly. So it's vital that the establishment of the new government, functionally the parliamentary commissions function in the Parliament”, says Hoti.

That with the assembly's constitutionalisation, opportunities have been opened to have a plenary session, even without the new government being formed, says Arbare Loja of the Group for Jury and Political Studies.

She said that for any extraordinary plenary session, the burden falls on new MPs, who after parliamentary commissions are formed can draft and proceed to the assembly to approve.

The “objection because it is constitutionally and functionally required to draft and proceed for approval in the country of the Republic of Kosovo budget, takes into account that so far, we do not have a new government and do not have coalition agreements. And the past government, she has no authority to do this... The responsibility of the commission for budget and finance is to become a budget because of the importance of the country not going into a collapse, then at the moment the new government is established, it can propose amendments and amending the budget law so that it reflects its governing” plan, she says.

While the Constitution's connoisseur, Mazum Baraliu told Kosova Preris that the seventh legislature cannot be fully functional without the formation of the new government.

The incumbent's “government cannot proceed anything to the Parliament because it is out of command. So the Assembly is constitutional, it's legitimate, it can work, but it can't work in the full sense of the word, because it needs to be for the Budget Law, which is the most important one, it should have the new government's proposal, rather than the government in office”, he says.

Although over 100 days have passed since the 6 October elections, the winning party Vetevendosje Movement has failed to form the new government, along with the second party, the Democratic League. This, as differences over power sharing have emerged in the negotiations between them. /E. Zeqiri/
