Charge brought against two Serbs for war crimes

The Special Prosecutor of the Republic of Kosovo has filed charges at the Constitutional Court in Pristina, the Special Department, against Mr. K and D. S. for crimes of war against the civilian population. The defendant, Mr.K.,, during wartime in Kosovo, as a member of Serbian police forces, has seriously violated the rules of International Humanitarian Law against civilian persons and property, namely, the rules of war imposed with the Geneva Convention on 12th August 1949 and State Protocols.

The defendant, Mr. K. On March 26th 1999, in the village of Greater Nerodime, the Ferizaj municipality has directly participated in the attack of the Albanian national population, namely, nineteen members of a family that did not participate actively in armed conflict.

During this action, the defendant, in addition, has participated in the torture of members of this family, the destruction of their property, the expulsion of their homes, the kidnapping and murder of civilians O.N., B.N., A.N. and B.N., members of this family.

These actions, Mr. K. in co-ordination has committed the criminal work war crimes against the civilian population by Article 142 concerning Article 22 of RSFJ Penal Law, criminalised even with the Kosovo Republic of Kosovo Penal Code with Article 146 as war crimes in serious violation of Article 3 of the Geneva Convention.

Meanwhile, the defendant D.S., during wartime in Kosovo, as a member of the Serbian police forces, has seriously violated international humanitarian law regulations against civilian persons, respectively, Article 130 of the Fourth Geneva Convention of August 12, 1949, in interconnection with State Protocols for the four Geneva Conventions.

Defendant D. The S., on April 1, 1999, in the quality of police inspectors, armed with automatic weapons, with the intent of desecration, humiliation and derogatory treatment of O.N.'s lifeless troops, B.N., A.N., B.N. and I.R., killed by Serbian police and paramilitary forces, has ordered their troops to be buried without dignity and contrary to the rules of war defined by international humanitarian law.

With these actions, the defendant D.S. has committed criminal acts of war crimes against the civilian population by Article 142 of RSFJ's Criminal Law, penalised even with the Criminal Code of the Republic of Kosovo with Article 146 as war crimes in serious violation of Article 3 of the Geneva Convention.
