Raqi years ago admitted to corruption. This was after about four years ago the Constitutional Prosecutor in Pristina accused Raci and three other Obilic municipality officials of misusing official office, Koha Ditore reports.

Criminal work criminal use of official duty has entered the chapter of corruption criminal acts. The LDK's then official MP candidate in the municipality of Obilic, Raqi, along with two other officials accused of corruption, had made deals to accept guilt, which was signed by three defendants, the prosecutor of the case and chief prosecutor of the Constitutional Prosecutorship in Pristina at the time was Imer Beka.

The plea agreement had saved these three officials from any possible prison sentence, as well as from the trial process.

The plea agreement was for the three accused to be sentenced to 5 months in prison on bail and forced to pay 70,000 euros.

According to the indictment that Pristina's Constitutional Prosecutorship, which was handled in 2016, municipal officials had enabled the company “Ardi” a material benefit by accepting the unprincipled work in Obilic's recretary park.

Raqi was a member of the commission to accept the works. About a year after that sentence, he had again returned to the bank of those accused of corruption.

In the indictment against former Obilic leader Mehmet Krasniqi was also charged with Raqi and several other municipal officials.

The Constitutional Court in Pristina and that of Appeals are found innocent in the face of the Special Prosecutor's accusations of corruption.

In February of this year, however, the Supreme Court has approved the request for protection of the legitimacy required by the State Chief Prosecutor's Office. The Supreme Court's ruling has found that two steps of the court have violated the law in favour of indictees when they have acquitted him of corruption charges former Obilic leader and other officials.

According to the Supreme Court's conviction, the reasons for releasing these officials from corruption charges are unclear and incomplete.

Despite the Supreme Court's conviction of law violations on the part of the judge's decision on this case, these officials cannot be prosecuted for the same acts again. This is because the Kosovo Criminal Procedure Code envisions that if the Supreme One finds violations of the law at the expense of the accused, then the subject turns into retrial.

While in cases where procedures or law are violated in the favor of the accused the Supreme Court only finds mistakes but without impacting the judicial procedure.
