Although it is prohibited by law to publish the vote and for that, punitive measures appear to be unknown to fellow countrymen.

Now for a few days, on social networks some fellow countrymen are publishing their votes.

But under the Kosovo Constitution, such a thing is prohibited with the General Election Law.

In Article two of this law, it is clearly emphasized that no one has the right to publish the vote because the vote is secret and guaranteed.

“Freedom and voter secrecy is guaranteed. No one has the right to prevent any citizen from voting, force him to vote in a certain way, hold him responsible for the vote, or seek against his/her will to reveal his/her vote or the reasons for not voting”, said among other things in Article two of this law where fundamental principles are even defined.

On the other hand, despite these publications, from the Election Panel for Anxiety and Parashtre (PZAP), have indicated that there has not been a complaint about misusing the vote in this body.

“PZAP, there is no official information, no complaint in PZAP, respectively, has been filed over these abuses of votes published in videos broadcast in Kosovo media”, said in the PZAP response to news release.

Mazlum Baraliu, connoisseur of constitutional issues, has said the vote is sacred and that its publication is banned.

“The voting work is prohibited by law. It means the vote is secret and individual, and it is a matter of determining the individual to a political subject, his affiliation, his belief, accession to full credibility in militantism. So the vote doesn't even do during the vote to photocopy in this case to get photographed, it doesn't even affect it. They are the legal and sublawing standards of the CEC that prohibit the sanctity of voting. Vote is sacred, a citizen vote. No one should or dare influence or dare blackmail, condition, or purchase it in different forms or conditional on whether I can say to traffic the vote”, Baraliu said.

However, regarding the publication of the vote by fellow countrymen, Baraliu has said of the news.net, that this may either be manipulation or exiles are unaware that such a prohibition is prohibited by law.

Such actions, even these of nature, that someone through that mail, is not clearly visible, but seems to be a manipulation. Even the CEC leader, she said it and I think it's something that someone just threw a dust to cloud our eyes, but anyway these are all prohibited and such actions are not allowed to anyone, so the diaspora citizens should also be careful because they might be driven by someone or initiated by some interest or even themselves without knowing the legal provisions of”, Baralou said.

According to him, despite living abroad, fellow countrymen, while having a right to vote, they are citizens of Kosovo and they must answer before the law.

“Bankers should remember that they are citizens of Kosovo until they are eligible to vote and that any violation of voter secrecy, vote-right, and especially of what is called privacy, personal privacy is guaranteed by law, and if it is violated, they violate the legal standards and such actions are sanctioned by law, and there can be criminal consequences because the Penal Code for more prespecting in certain actions which violate the electoral process, the impact and all that they have to do with a dignified, democratic and electoral process that is violated by anyone who is violated by the Penal Code, and Penal will have to answer to the law, Bar.

It should be stressed that the post office vote was initiated on September 19th and will last until October 5th.

According to the Central Election Commission, there have been 40 thousand and 313 registration applications for early elections that have been accepted and prosecuted, but only 35 thousand and 87 apps have been approved since 5 thousand and 226 apps have been rejected due to the failure to meet legally defined criteria.

We remember that until early elections it has been due to Ramush Haradinaj's resignation from the prime minister's post, arguing he has been invited to the quality of the suspect by the Special Court.
