Periscope: President Hashim Thaci today asked the coalition PAN to propose the consensus candidate for the country's new prime minister, following Ramush Haradinaj's resignation. What are the procedures on both sides?

 

Ramush Tahiri: This is the regular procedure President Thaci has made. He could've done it earlier. It had to be done early because you can see both the Law and the Constitution of Kosovo. Article 95, point 5 is clear. Now they're just following procedure. The UN has to send the name of the prime minister or say I have no name. The president then decides whether to target the second candidate, or to request the second candidate and reform all legal options. Otherwise, the Constitution says the legal deadline is 15 days, from the day it is called to present the government cabinet at the Assembly meeting. D.m. it's seven or eight days. The Assembly then adopts it somewhere within five days, which is down to 20 days, depending on how calculated, if that's the maximum deadline. It may be 15 days later, but it is usually not.

 

Periscope: Coalition parties have a deadline PAN to propose the name for new prime minister?

 Ramush Tahiri: They send the proposal now. They don't have a deadline. That's not before. It's already been envisioned in 15 days, but it's not. The president on paper has clarified the legal procedures and now they with a letter should respond to the president, as he has not invited them to consult, but has asked for a letter from the owner of the list or the chairman of the list. The UN, which is formally Kadri Wessel. Now Kadri Wessel has to meet with PANU partners and deal with them whether they have a common candidate or not.

Periscope: What if PAN doesn't date a common candidate?

Ramush Tahiri: If they do not have a common candidate, then Hashim Thaci must be recognised as president that we do not have a candidate and the president can then calculate that they do not have a candidate and that the candidate is not a choice. Then there's a procedure that's asked for second, on a ten-day deadline. I ask them if you have a candidate. On this second part, there's an opinion dilemma. Whether a coalition should give the second candidate or the other party, which makes 61 votes in the Assembly. I am a supporter not of this coalition, but of the other second winning party. But there are objections. But, I defend this position because for me, the second opportunity does not belong to the candidate but belongs to the coalitions. If the coalition has led a candidate, and the candidate has fallen down, he has not received 61 votes from the Parliament, or the candidate has not gone at all, because they have no candidates, then the president commenting on the appointed Article of the Constitution, calls the second party, or the ruling Vetevendosje or the LDK) asks them whether you have a candidate to make the new coalition. If they say they have a candidate, and they have 61 votes in writing, then the president decrees or nominated this candidate and sends him to the Assembly. Then the Assembly will hold the meeting no longer than two days later than five days from the day the letter has reached the Assembly. There are other people in the opinion who think it takes twice the same winning subject to grant the candidate. The law practice of all other countries, but even in us with the constitutional framework, is to be given the winning party, and that is highlighted. But in our Constitution, it doesn't matter whether the second or the first party.

The President sends them a letter The UN, who targeted a candidate for prime minister and continued the government without an election. Kadri Wessel calls Fatmir Limaj and Ramush Haradinaj and agrees on the common candidate. If they take the name to the President and the president takes the name to the Parliament, and within five days the Assembly meeting is held and voted. If the candidate doesn't vote by 61, then repeat procedure with the second candidate, but the deadline is 10 days, it's not 15 now. In the situation we find ourselves in, PANić, when Ramush Haradinaj seeks to go to the elections, not with a new candidate, when he calls Kadri Veselin in consultation, they can say that we do not have consensus candidates, and my opinion is that if they do not have a common candidate, Kadri Veselin does not bring the name and announce to the president that they do not have a candidate. The president starts for the second candidate. I think the president should call the second winning party. Either Vetevendosje (before the breakup) or LDK. He says you have a candidate. If the second winning party says we have it, they go to the president and they give the candidate name for prime minister. But I am more or less the list of deputies who will be voted into prime minister. Don't take the Prime Minister back to my place. Or he won't give it up and he says I have the conviction that I have made a coalition and he takes it to the Parliament. The president takes him to the Parliament and votes for the second candidate. If the second candidate doesn't pass, then the country goes to the polls, it's not 45 days, it's 40 days. The Assembly then goes to general elections within 40 days and the president announces the elections in the deadlines of the day he has failed to elect the second candidate for prime minister. The Assembly then spreads a month before the election process, because it cannot work during the election process. But 30 days before it should be distributed.

Periscope: How long will all these procedures take?

Ramush Tahiri: Everything's going on a month in these procedures. Until Kadri Wessel consults, until they bring the name to the president, now the new candidate has 15 days until he makes the cabinet government. Now the Assembly has five days until it holds its meeting, now when the vote is voted and this candidate falls. Then the next designated candidate, who has 10 days to make the cabin. From what I see, 30 days or 40 are just procedures, if all is respected.

Periscope: In your opinion, will the common name come out of PANU, or will it be taken to extraordinary elections?

Ramush TahiriRamush Haradinaj has said he is not interested in continuing this government, or after consensual candidate. Maybe he proposes someone from his own party, and they agree. I don't know. If the three leaders get a candidate, if they don't understand, they'll take the letter and say we don't have a candidate. Then the president shouldn't ask the court, but consider that the candidate scan and made an effort for the second candidate. But if the political parties, the LDK, which tomorrow has the election seat, considers it necessary to go to the elections, then the one with Vetevendosje collects the signatures from Kadri Wessels also requires that extraordinary sessions are held and the distribution of the Parliament itself be voted on. If this decision is positive and gets 80 votes, the Assembly is distributed. All procedures are interrupted over candidates, and the president sets the date for 40 days elections.
