Betim Musliu from the IKD said that Kosovo's Institute for Justice is constantly monitoring the justice system in Kosovo, where the largest number of hearings are transparent, but according to them there are illegal actions.
“We, like KDI from 2013, systematically monitor the justice system and so far we are following challenges in access to judicial hearings involving the criminal sphere”, Musliu said.
“The report analyses some of the concrete cases of hearings that have been illegally and arbitraryly closed to public court hearings in criminal cases, but in principle the judicial system in terms of transparency is transparent the majority of sessions are public and accessible to journalists of the Serbian public”, EO reported.
Musliu said there have been illegal decisions in hearings by not allowing camera footage by civil media and society.
This year during the monitoring process, we have seen that there may be illegal actions and that video footage of the camera doesn't stop shooting with cameras, except for judges that were obstructing”, he said.
The controversial judge has expelled us from the session to shoot with the” camera, Musliu added.
Gezim Shala from the IKD said there have been cases when judges have also taken the role of prosecutors.
“We have seen cases when judges have assumed the role of the prosecutor and for preparation hearings for the appointment of security measures”

Some of the IKD recommendations were:
The judges reconsider their decisions for closing sessions. Judges are treated to understand correctly the purpose of public keeping court hearings. Decisions for closing sessions to be rationally consistent with legal requirements and standards set by G EDNI and for this area they must be constantly treated, after developing KDR training, should monitor the implementation of the GEDN practice and judges who do not go on this line should generally call”, the report published by the IKD says.
