The Swiss group was invited by a friend. At that time, the group consisted of only 30 members. In June 2017, the Swiss warned the group in Whatsapp for a radar on the response between Niederweil SG and Gossau SG. At the request of a member of the group, he specified the words: “in the forest or under the bridge of the” highway.
The prosecution then pronounced the punishment order for warning the opinion of traffic control.
Against this punishment, he filed complaints. In this case, the subject was brought before the Regional Court.
The man was protected by the argument that whatsapp is not public. The group had no access to everyone, like a Facebook group. Group attachment is only by sending an invitation to the manager of the group. “Facebook is a platform. Whatsapp is a message exchange service”, the defendant's defender has argued.
The Arbon Regional Court deemed the case differently and sentenced the Swiss to a fine of 500 francs, Albinfo.ch informs. In addition, it also has to pay judicial expenses in a total of 1,600 francs.
The decision is not yet final. The accused wants to prolong the decision. Only then will he decide whether to take the case to the highest court.
This is not the first case of this type: A year earlier, a person had been convicted of warning in Whatsapp.
