KDI wants the Assembly to have only a monitoring role in dialogue

The Kosovo Democratic Institute (KDI) has held today a press conference, following the Constitutional Court's act on duties, responsibilities and competencies of the state delegation for the dialogue process, where it unveiled recommendations about the future of this process. In this case, Life Krasniqi from KDI has stressed that the Constitutional Court's act regarding the Constitutional Law on the State Delegation marks a turning point in the process of dialogue, removing all dilemmas concerning the role and responsibilities of constitutional institutions in the foreign policy field. After opposing the Law in the Constitutional Court by the two opposition parties, the LDK and the LVV, the Constitutional Court's act clearly determined that the competencies of constitutional institutions cannot be delivered to specific mechanisms which are not preceded by the Constitutions. “The bias found that the Law as such violates the principle of separation of power, democratic values of governance, the exercise of competencies of the Parliament, the Government and the Prime Minister in the foreign policy sphere”, it has said.

According to Krasniqi, ahead of the Parliament Law vote, KDI has shared with the Parliament's deputies an analysis of this law, where it has raised issues related to power sharing, institutional hierarchy and other shortcomings that accompanied this law.

KDI has consistently called for the political spectrum to reach consensus on the question of dialogue, welcoming initiatives undertaken in this direction that turned the discussion into the Kosovo Assembly. This unity of the political spectrum could not be formalised even after efforts through the establishment of the State Delegation in December last year.

About six months after the delegation's founding, Krasniqi has stressed that, it can be concluded that its functioning and role has been in the marginal Souza, both in achieving internal consensus and in representing Kosovo in the external plan. The delegation's role has been limited only to holding co-ordination meetings with the country's institutional leaders, or informative meetings with various international factor officials, as well as accredited diplomatic representatives in Kosovo.

The entire period of functioning of the State Delegation has been accompanied by a serious lack of transparency and accountability against the Parliament, civil society and citizens in general. The practice of nontransparency has also been noted in terms of spending and employment in Delegation, in his administration, respectively, for which the government had allocated vehicles worth 300,000 euros”, she added.

Taking into account all developments after the delegation's founding, especially after the Constitutional Court's act regarding the State Delegation Law, KDI offers recommendations for the next phase of dialogue, as follows:

“KDI calls on all institutions to respect the Constitutional Court's act and act in accordance with it. The process of dialogue must be returned under the leadership of the country's prime minister and under the regular supervision of the Kosovo Assembly”, Krasniqi said further.

The prime minister and president must consult and function co-ordinated under their constitutional responsibilities, putting aside political clashes about representation in the process;

Kosovo must articulate its unique position regarding the final and legally binding agreement between Kosovo and Serbia. This process should precede a broad political and social debate, under which guiding principles, red lines and topics or topics that should be presented and pushed forward by Kosovo institutions are defined. In this direction, the Government of Kosovo must clarify the validity of the platform proposed by the State Delegation, which was voted into the Kosovo Assembly, if the same remains as Kosovo's official position in the process.

The dialogue process should be carried out on the basis of red lines, which should ensure that Kosovo's territorial integrity, the unitary internal functioning of the state, the status of Kosovo finalised as an independent and sovereign state, as well as Kosovo's sovereignty as a full and equal state in the international arena.

Reaching the political consensus remains important to further the process of dialogue in maintaining the interest of the state of Kosovo, in line with the constitutional preparations of state institutions. The political spectre must put aside daily political calculations, and should build long-term attitudes for the state of Kosovo;

The Kosovo Assembly should keep the accounting government in terms of the dialogue process, having an active and more efficient monitoring role. Parliamentary commissions and Parliamentary MPs should use all the monitoring mechanisms available, including calls to reporting, interspelances, field visits and others, to ensure the management of the process, to ensure the implementation of agreements and to require accountability. The Assembly should not allow its bypass as the country's foreign policy watchdog;

The closing phase of dialogue must undergo full transparency. The prime minister and president must report to the Kosovo Assembly on discussions, which have been held about the final phase of dialogue. The prime minister should offer clarifications concerning the State Delegation's expenses. Above all,

The prime minister, in the post of dialogue leader with Serbia, must build the practice of regular reporting in the Assembly regarding this process. The government and Parliament must develop civic information practices concerning all developments within the dialogue process”, Krasniqi concluded.
