Based on reports of organisations monitoring the work of the judiciary, it turns out that there are many years the courts face large numbers of subjects and with lack of sufficient number of judges.

Hamit Izeti resident of the village of Greme, Ferizaj municipality, says there is a property dispute in court for more than ten years but has not yet managed to receive a final answer to the conflict.

“E has a course in court since 2005, which means 14 or 15 years. For the classes I held 40 sessions and didn't make a choice. I think that if justice and law were functioning, there was no need more than once or twice to go to court on my case”, Izet said.

Because there is a delay in solving subjects, representatives of nongovernmental organisations who monitor the work of courts and prosecutors also say.

The executive director of the Kosovo Institute for Justice, Ehat Miftaraj, said that for the reduction of the substances in courts, there is no proper management.

He says citizens face numerous delays in dealing with their subjects, and this, according to him, is mostly noted in civil and administrative issues.

“Of course the most charged court is the Basic Court of Pristina. Citizens seeking justice in this court can't almost get an answer 5-6 years ago or even 10 years ago, except if the same are related to persons who somehow violate the principle of citizens' equality in treating subjects”, Miftaraj said.

Miftaraj considers that another negative factor in this direction is the lack of professionality of judges, since the Court of Appeals in many cases has turned into a lot of subjects.

In these cases we've called them the table tennis game, where one case happened in practice to be returned up to five or six times by the Court of Appeals to the Constitutional Court of Restitution. And another factor is that judges, the Judiciary Council, the mayors, should have a much more efficient administration in relation to the judges, as they do not always give due attention to cases in courts, as we do not rarely see that judges are at seminars and workers and at work. No doubt this affects the efficiency of their work”, Miftaraj said.

Kosovo Judiciary Council chief Skender Cuchaj said there are two courts -- the Founding and Appeals' -- which are the most charged with work.

The “Vonesa has at the Foundation Court in Pristina due to large volume of the subjects. There are no delays in other courts. The only problem is at the Court of Appeals in the Civil Equipment and at the Constitutional Court in the general department in other courts there is no. We're taking action here too. For a year only in Pristina we have sent about 40 judges, so these delays are expected in the future to be smaller”, Chocaj said.

In Kosovo courts, there are still large numbers of outstanding subjects. Currently, there are over 245 thousand old or new materials, awaiting resolution from courts throughout Kosovo. But, according to justice system leaders, this number will fall, as in Kosovo courts there is an added commitment of officials responsible for this issue/Rel.
