Honored citizens of the Republic of Kosovo,
I address you in these difficult moments for me, my family, members and supporters of the Justice Party as well as numerous friends in the country and abroad with the feeling of having to share with you the truth about this judicial process that is now clearly seen as having had heavy political background from the beginning. Difficult moments, not because of the type and extent of the sentence pronounced against me today in the Pristina Constitutional Court because it has nothing to do with the truth, but because of the severe disappointment I experienced in this court today, which without fail with its decision denied all statements of witnesses, experts and all the material evidence presented during this three-year judicial process.
I consider that I have met with dignified accusations of the Prosecution since the first day of their official establishment, resigning from the post of Minister of Environment and Spatial Planning to enable fair and impartial judicial process, as well as refraining from any intervention and political interpretation as the head of the Justice Party throughout this lengthy judicial process. I believe that with this I have set a political standard which is clearly difficult to reach for most senior political officials of the state. Today, however, it proved that just personal examples are not enough for the quality establishment of the country's judicial system.
It is very heavy to disregard the legal provisions in force which today's ruling has made Pristina's Constitutional Court. The violation of the legitimacy and constitutionality made with this decision was serious and crazy. In short, I would like to stress that I have been found guilty of:
- Do not stop signing the agreement with private hospitals while with concrete legal provisions it has been binding to sign such agreements.
- Do not announce the tender for providing health services while the Public Finance Management Law and the Financial Rule issued by the Ministry of Finance stipulates that tools from the category of subsidies and transfers do not apply public procurement and no tender is announced. So on the case which is regulated by the Law as such, I am found guilty of law enforcement.
- I have been found guilty of misusing official duty for the period until December 2015, when I was not at all a minister of health. How can this honorary citizen be understood, how can I be guilty when in the post-December 2014, I was not a minister of health?
- I was convicted of failing to stop the deal that was in effect even before I was appointed minister of health and procedure that continues to apply to this day despite several health ministers. The procedure goes on identically, and in all of this process I am found guilty. How can all of this have legal reasonableness?
- I have been convicted because of the damage to the state budget worth 4.5m euros, while the State Lawyer itself as representative of the Republic of Kosovo for no moment has presented itself in the judicial process and provided no arguments to the supposedly caused damage. So how are there penalties for damaging the state budget while there are no damage caused.
- I have been convicted of the damage caused at 4.5m euros, while for the same value damage, 2 separate court processes known as STENTA 2 and STENTA 3. So how come for the 4.5m-euro damage that was initially claimed to have been caused by all the accused, Mr. and I have been sentenced. Ghani Shaban, while the other two processes have not yet been completed, and in those processes the Prosecutorate claims there is damage to 4.5m euros in each process. So the damage during the procedure has been tripled by the Prosecutor and the Court, respectively.
These are just a few of the many anomalies in this entire judicial process and facts that explain the injustice done to me by today's judicial decision.
How to explain the fact that I was sentenced on the basis of an Aktakuze, which was illegally promoted by the State Chief Prosecutor's Office when the same had no competence for that. The subject was taken arbitraryly to the Special Prosecutor to go to the chief prosecutor's office, while after the establishment of the indictment the subject was represented by the Special Prosecutor, who was no longer competent under the first decision.
I will take all relevant legal measures in all judicial institutions of the country so that such a decision will not be passed to the Court of Appeals. I have the hope that at least the Court of Appeals will professionally address all the arguments presented during this trial on my part and that these illegal errors will be sanctioned and eliminated on its part.
Honored citizens of the Republic of Kosovo,
I would like to assure them that today's decision will not waver in my political and state commitment to further building Kosovo's promotional state, which will not be emptied every day by young people and other citizens as it is happening these days, but will instead strengthen me even more in the historic battle which all together need to win against ignorance, professional dignity, injustice, intrigues and blackmail in politics and the state that have become harsh and harsh, today concrete once again in the Constitutional Court of Pristina.
