The Administrative Court has decided that Kosovo must abandon Switzerland after it has concluded that it has made its breaking divorce with the woman in Kosovo to then connect more than a fig marriage in Switzerland. By his actions he has “brought the authorities on his own “Solothurner Zeitung”

In October 2017, 45-year-old Kosovar has applied to the Cantonal Office for Migration in Solothurn to bring to Switzerland his three youngest children, who are with his first wife. And his move led authorities to doubt that his two younger children were born in 2006, 2011, the time when the applicant was no longer married to Kosovar, but to an Austrian citizen. The marriage in question had enabled him permanent residence in EU states. While he has had five children from his Kosovo wife, he has been divorced since 2003.

Driven by doubts, Swiss authorities engaged in Pristina immediately two delegations from the Swiss Embassy in Kosovo. One was taken to the house where the former wife and the other were officially living in the home of the applicant's mother. What they found was interesting: The woman did not live at the official address. She, with her children, continues to live in the home of her husband's mother, who was officially divorced 15 years ago, records albinfo.ch. To be the most precise story: the same day the man had shot at “ish” the woman. Authorities from the Swiss Embassy found a normal couple's bedroom there. And at the woman's official address, those in the rooms that were claimed to be her own found only pictures of relatives but not of her children. In further search of the house at the official address, it has resulted in empty.

The result of all this for the man in Switzerland was: The Solothurn Migration Office has now not only rejected that requirement for family reunion (bringing children to Switzerland) but also canceled its right to stay in Switzerland.

The Administrative Court has confirmed this decision, as can be read in a decision published a few days ago, broadcasts albinfo.ch. In their argument, judges alone say: “that a woman after the failure of a relationship and the subsequent divorce continues to live in her mother-in-law would be considered something very extraordinary even in Switzerland. While in traditional social structures that reign in Kosovo, this should practically be viewed as something disfellowshipped”.

For them, the question is clear: The man was divorced onlyally by the Kosovo woman and then married onlyally as well as with women who had an EU passport (after the Austrian divorce from him in 2016) he married a Czech woman, who settled in Switzerland in 2016).

As evidence of the existence of a nuclear marriage, authorities have praised the situation that the husband's new wife has not even been with her in Kosovo, nor has she known the children he wanted to bring to live with her in Switzerland.

Kosovar, on the other hand, says he had returned to his former wife in Kosovo only after the former marriage was already broken. So he now lives happily in the third marriage.

He has complained that embassy employees in their report have marked the wrong data and that he has never been able to express himself regarding this report, albinfo.ch conveys. But the judges of Solothurn have shown no understanding of his statements. While the fact that the one in Switzerland is employed by his former Kosovo wife's brother, they see him as more evidence than his divorce had been extinguishable.

Eventually, authorities and judges have come to the conclusion that the 45-year-old “marriage to his third wife has only been linked to obtaining a residence permit”.

Kosovar must pay 1500 francs in the name of procedure spending. He's right to complaint at the Federal Court.
