Constitution abolishs discriminatory Article of Red Cross Law

The Constitutional Court of Kosovo has abolished paragraph 1.7 of Article 14 of the Law on the Red Cross of Kosovo, considering it contrary to the Constitution.

Through this article, only Kosovo insurance companies have been charged since 1 per cent of the surrender from the sale of Security Police to share for the Red Cross.

Viewing it as discriminatory, Kosovo Security Association Director Sami Mazrek, finding the same practices as in Kosovo, has addressed complaints to the country's institutions, and where the Constitution has generally declared the demand, declaring Article in invalid words.

The court's ruling, which today has been sent to the director of the Kosovo Security Association, says that the court decides to proclaim Article 1.7 of the 14 Law on the Red Cross of Kosovo, is not in accordance with Article 24 (Barazia prior to the law), Article 119 (General Pristina) and Article 46 (The Protection of Property) of the Constitution.

Furthermore to Article 3 it is said that the court decides in accordance with Article 116.3 of the Constitution that paragraph 1.7 of Article 14 of the Kosovo Red Cross Law is invalid from the day of its entry into force.

Director Mazreku says an injustice and discrimination are finally being corrected.

The Kosovo Red Cross legislation is identical to that of Croatia's state. Thanks to a great commitment I have offered abundant evidence that such a practice has been long ago described as unconstitutional even by Croatia's Constitutional Court. From today eventually insurance companies will be treated the same as all other companies operating in Kosovo”, director Mazreku has said.
