Kosovo Democratic Institute/ Transparency International Kosovo has consistently conveyed the statements of Infrastructure Minister Paul Lekaj concerning the completion of the work regarding the contract.
Today, during a media conference, Diana Metushi-Krasniqi of KDI also made the presentation of this contract that proves that.
She pointed out that in Anex Contrata, you can clearly see that Article 5 lasts the end time for 152 days, until Article 9 obliges Government to complete all expropriations, and to guarantee the contractor access to the workshop site to complete the works.
To understand the terms used in the annex, we should also refer to the main contract where Article 8.2 defines the term term as:
The contractor will complete all the work, complete each part (if there is), within time for completion of the works or sections (part parts), including:
(a) Reaching test crossing after completion, and
(b) The outcome of all the jobs declared in the contract as necessary for jobs or sections (sections) to be regarded as completed in order to accept the definition of sub-claudia 10.1. [approximate-handling of jobs and sections]”, has added further.
Metushi- Krasniqi has stated that KDI is asking the Minister of Lekaj instead of denying KDI's findings, to give public clarification on how it increases Kosovo's government obligation from 14.78m in 2016 to 53.1m euros in 2017.
We understand that as a result of delays in realising payments to Bechtel& Enkas, the Government of Kosovo, based on the basic contract, must pay the contractor an additional cost.
Anex contract, which we are publishing, accepts Government obligations to Bechtel& Enka, but it doesn't define what this much covers. Article 3 of this annex defines 53.1 The Euro billion is the value of extending the contract's deadline for January 18th, December 31st, 2018, while articles 6, 7 and 8 say that with the signing of this contract the contractor agrees there will be no claims regarding budgetary shortages through 2014 to 2018.
KDI called on justice bodies to investigate in an expert way the reasons for the loss of 53.1m euros of Kosovo citizens, as well as the estimated 53.1m euros for continuing the January 18th-December 2018 contract, respectively, June 2019.
