Constitutional Court Responds to Kadri Wessel over his request for an amendment

On October 24, 2018, Wessel referred to the Constitutional Court of the Republic of Kosovo, an amendment to the Constitution proposed by 80 (eight) deputies of the Republic of Kosovo, asking the Court to make preliminary assessment if the proposed amendment reduces any of the rights and freedoms guaranteed with Chapter II of the Constitution.
The proposed amendment envisions adding a new paragraph after Article 8 [direct implementation of the International Agreements and Instruments] of the Constitution, respectively, to add paragraph 9, as follows:
“) The Council of Europe Convention on Prevention and Combating Violence Against Women and Family Violence”.
As the Constitutional Court ruling states, amendment propossors claim that the proposed amendment “defines important standards in the area of violence against women and domestic violence and is aimed at protecting women from all forms of violence, and prevention, prosecution and elimination of violence against women and domestic violence. ”
The court found that the wording of the proposed amendment does not diminish any of the rights and freedoms specified in Chapter II of the Constitution.
