The accused object to evidence presented in the case ofpronto

At this hearing, the accused and their defenders are opposing evidence presented by the prosecution asking the Court to cast this indictment that, according to them, is not based on evidence.

The defender of the accused, Adem Grabovci, lawyer Florent Latifaj, took that stand.

I stand overall next to the submitted parachute for rejecting evidence and demanding to drop the indictment”, Latifaj said.

The defender of accused Ilham Gashi, lawyer Guzim Kolcak, had the same request.

And I as other defenders have applied for countering evidence and dropping the indictment. I have explained and reasoned why such an indictment should be dropped on the court's side and also given all my claims that I have considered that unless the indictment has any basic evidence, all the evidence the prosecution has been called does not apply to this process”, Kolcak said.

Lawyer Besnik Berisha, who in this process advocates accused Besim Beqaj, had a ruling against the tribunal.

You said you accepted our requests for dropping the indictment but did not tell us if the prosecution has returned to our objections”, Berisha said.

This statement by the lawyer intervened with special prosecutor, Dr. Hajdari, who represents this indictment.

I have “remarks regarding this lawyer's request. On the basis of the Criminal Procedure Code, defendants and their defenders first present objections and then the prosecution answers in their objections, there is no need for the lawyer to impose rules”, she said.

In this hearing, lawyer Besnik Berisha has appeared without platoon in the courtroom for what has been warned by Judge Shashivar Hoti.

And lawyer Emrush Kastrati, who defends the accused Besnik Shurrhej, had another version of the charge.

This charge has been filed more in media pressure. My conviction is this and it has nothing to do with incriminating actions of my client”, he said.

In April last year, the Special Prosecutor of the Republic of Kosovo filed an indictment in the case called “Proto”.

In this criminal case, eleven people with top official positions are charged: former US Vice President Ademi Grabovci, current minister Besim Beqaj, current deputy Zenun Pajaziti, two former secretary general, Ilham Gashi and Xhavit Dajaj, former Deputy Prime Minister Fatmir Shurdaj, political adviser to MPB Sadat Gashi, former director of the public company's board “Randoniqi-Dukani <X1> in Gjakova Isaj, former director of the public company <2Hdrot> at Abzhsi>, former Prime Minister of the former Parliament and Minister for Defence Equikafia in Pajni, Apojazijani, former Minister for the former Parliament.

According to the Special Prosecutor, the accused are charged with carrying out the criminal act -- the violation of equal status of the citizens and residents of the Republic of Kosovo in co-ordination -- by Article 193 paragraph 4 concerning KPRK paragraph 1 -- regarding Article 31 of which some of the works have remained on the attempt.

According to the indictment, defendants have misused their official positions by co-operating among themselves in granting privileges and priorities illegally to those who have competed in important positions, such as directors for central public enterprises, chief executive head of the Internal Affairs Agency, head of the Agency for Medical Products, and co-ordinator of the Civil Record Centre in the Cline, denying and restricting the freedoms and rights of other candidates, guaranteed by law.
