Kosovo's Academy of Sciences and Arts, on the eve of marking Kosovo's 11th anniversary of Independence, expresses serious concerns about political discours, especially from the bearer of institutional responsibilities, regarding the latest phase of the dialogue process with Serbia, saying that the lack of unique state platform and the controvous and divisive positions between the carriers of the country's main institutions are unacceptable.
A The SHAK considers that tense disks for changing borders between Kosovo and Serbia as an old Serbian idea and plan, in the form of “correction”, “exchange” and Kosovo “is with very damaging consequences to Kosovo's independence, state sovereignty and territorial integrity and its interests.
Republic of Kosovo, according to A The SHAK, the final phase of dialogue with Serbia, should develop within the constitutional and legal framework in force and in support of the constitutional competencies of state institutions.
A The SAK considers that the Republic of Kosovo, the next final phase of the dialogue, should be carried out in the implementation of the UN General Assembly Resolution, A/RES/64/298 of 9 September 2010 with which the International Court of Justice's advisory opinion on the compatibility of the Kosovo Declaration of Independence with International Law, with which the way has been opened to enter inter-state dialogue with the Republic of Serbia, assisted by the European Union.
The Republic of Kosovo can hold the final phase of the dialogue, in front of Serbia or third parties, only as an independent, sovereign state, internationally recognised by 115 states and confirmed by the International Court of Justice (the Law of the Declaration of Independence of Kosovo on 22 July 2010), under constitutional frameworks that the sovereignty and territorial integrity of the Republic of Kosovo is inconsistent, irresistent, and inseparable as defined by the Constitution of the Republic of Kosovo.
A The SHAK also stresses that the country's internal regulation is sovereign competence of state institutions, regulated with the Constitution of the Republic of Kosovo, and that the Ahtisaari Plan is the only platform for regulating rights and guarantees for communities, integrated in the Constitution of the Republic of Kosovo, and offers wide range of specific rights for the Serb community, which exceeds international standards for community rights.
Kosovo Serb majority municipalities association, according to A The SHAK, could be founded in full compliance with the Kosovo Constitutional Court Act in order to preserve the unitary character of the Republic of Kosovo, as well as the function of the state.
The Republic of Kosovo should not allow or agree to negotiate any change of borders between Kosovo and Serbia, in the form of “correction”, of “exchange” and of Kosovo “ ”, because this would have irreparable consequences for Kosovo's international citizenship and subjectivity, especially when the fact that President Martti Ahtisaari's document and other documents, such as: Kosovo's 1974 Constitution of the KSA, the Declaration of Independence of February 17th 2008, the Constitution of the Republic of 2008, and the International Court of Justice's mentioned Council thought, the KFOR map that clearly defines Kosovo's borders, corresponding to 10,905km2, which refer to the current territorial integrity in which Kosovo's borders are defined.
A The SHAK considers that any territorial-ethnic division of Kosovo, outside clearly defined borders with the Constitution of the Republic of Kosovo, would jeopardise its failure to exist as an independent and sovereign state, as if the fragmentation of the Presevo Valley would wipe it out as entity.
Likewise, any discussion on the border issue would jeopardise the current European Union pressure on the Republic of Serbia for decentralisation of power in favour of local autonomy, which would directly affect the development of the Presevo Valley.
A The SHAK requires that our country in the next final phase of dialogue should use it as an irreversible opportunity for advancing the constitutional position and legitimate rights of the Albanians of Presevo, Bujanoc and Medvedja, in parallel with those of Kosovo Serbs on the basis of the reciprocity principle.
Moreover, A The SHAK finds that a political and national consensus is necessary in order for the process of dialogue to be completed with full success and in line with the interests of our country.
Republic of Kosovo, final phase of dialogue, according to A The SHAK, should develop in co-ordination and in close co-ordination with Western allies, both the US and the EU, so that representation and protection of national interests in this process, will be the continuation of the contribution of strategic partners, as in the phase of fighting for freedom, for state, for peace, for regional security and stability.
A SHAK in this case calls for the president, prime minister and deputies of the Kosovo Parliament to stand firm in protecting the whole and territorial sovereignty of the Republic of Kosovo.
