Ombudsman Hilmi Jashar has told of some of the complaints that have been filed at this institution for the Criminal Law in the Public Sector, which he describes as valid complaints.
There have been complaints which have correctly identified positions that are not covered in the Law for the Salaries, not found at all in the annexes of this law, nor are they mentioned anywhere. The dilemma here was how these officials or these people will be paid after the law goes into effect”.
“We have had concerns that have also brought one of the key authorities to this country that is authorised to make the signing of wages at the end of the month that has raised concerns as authority over what is the solution to this” situation.
The Treasury Director has had a very fair response because he is the person who eventually puts the signature on a fee that is 100m euros”.
But what if the new Law for the Salaries in the Public Sector was implemented the way it was drafted?
“Mbi base of all this experience in this area, I'm pretty sure the damage would be much greater if this law began to apply in the way it was drafted. If it were properly met, against minor defects, it could be regulated in the meantime”.
We have had plenty of opinions that we sent to the Assembly with the request to meet it or this defect in certain provisions. As a whole, the law would create more confusion and damage than a clarity and judicial security for all employees in the public sector”.
He in the Kosovo District B has also commented on the pressures that have been made so that the Law on Salaries in the Public Sector is not sent to the Constitutional Court.
If it is publicly said that the ombudsman does not dare to send to the Constitutional Court and that constitutes an anti-state and anti-European value, I think it's trying to exercise influence”.
But do you think Hilmi Jashari that his decision to submit this law to the Constitutional Court could destabilise the incoming government?
The occupy of the people is the apolitical institution not only in Kosovo, but anywhere in the world. The main goal and goal is to protect human rights and freedoms, and in this context the assessment of the <x1) laws falls.
The only thing we've done is exercise constitutional authorization. If it could be a problem for someone to exercise constitutional authorization, then let's assume they change the Constitution. While they are, I think that all citizens of this country, including public institutions, should submit to this principle”.
We dare not question the authority of the Constitutional Court and authorisation of the ombudsman for a request to assess constitutionality. Otherwise, there would be no sense to the existence of either the Constitutional Court or the ombudsman”.
